Condition - New or Open In Box

Hello All,

 

Infrequent seller here. I'm currently selling a laptop docking station. It was shipped to a relative by mistake and was never opened. The box was brand new with manufacturer tape sealing it closed. However, there was a small label stuck to it for a different item (likely the reason it was sent by mistake) so I cut the tape to open the box and verify contents. Nothing was unwrapped, all items are accounted for. There is also a correct product label on it with barcode. Literally the only thing altered from factory is that the manufacturers tape on the box was cut and it is now resealed with different tape. I've listed it as Brand New but indicated in the item description that it was opened to verify contents. Open box did not seem the appropriate condition since it is Brand New in every way other than tape being cut. I would appreciate any input from more experienced sellers as to whether this is the correct approach.

Open box is typically (for stores) a display unit; Copier, Cellphone etc. (something that is not turned on and used, just out so it can be seen) It's not new (and really COULD be used, but the term 'Open Box' and the fact that the store/manufacturer stands behind the warranty makes it sellable). 

 

If the 'tape' is a 'factory seal' and says so, then Open Box would be correct. If it's any old tape that you can replace, since it was never used, I would use 'NEW'.

Once it has been opened it is not new according to ebay definitions. I would err on the side of caution and list New Other or Open Box. Explain in the description what the situation is.

New is new, per ebay: "An item that has never been opened or removed from the manufacturer’s sealing (if applicable). Item is in original shrink wrap (if applicable). "

 

Anything other that is not "as applicable."

 

If I purchase a piece of steel pipe it doesn't come in a wrap.

 

Granted there's tons of things for sale on eBay as "new" that have been opened, whether used or not doesn't matter in warrants of merchantability in the USA.  If a cardholder files a chargeback with claim its resealed a vendor might dispute that via their merchant account saying, "No it was sealed."  If the vendor is honest in response to the chargeback, "It was sealed, I opened it to inspect the contents then resealed it" the chargeback will be honored.

 

Its actually one of the biggest gripes I hear from friends, family etc about eBay and why they refuse to shop here now-a-days.

eBay used to say removing an item from the box to make sure it's not defective or to take a picture of the actual item doesn't make it used. 

The definition of open box says it's  in the original packaging but not sealed.

 

You might want to get an answer from one of the blues.
