I have a spinning spa brush, looks like for shower use. But I can't select "open box" only new. I could tell that the box was re-sealed so I opened it to ensure content was there. I can tell it's never been used because brush heads were packed and batteries were still wrapped in plastic. But I don't want to list as "new" cause I opened the box.
Am I just taking a loss here?

I'm commenting as a buyer.
I would have no problem purchasing that as a "new" item. The item IS new. For full disclosure, though, I would want to see it mentioned in your listing that packaging was opened to inspect the contents.
I don't see anthing wrong with that. Nor should any other reasonable buyer.

It may be considered new by some, but if you list it as new, you risk a INAD. You could list it as used, and in your title add "OPEN BOX" and describe the situation in the description.

With your spin brush, you're talking about a product people use on their skin. Things you use on your skin, or that you wear close to your skin, generally do not have a "open box" Condition. Sellers know there is a difference between open box and used, but most buyers see them as the same (and the seller just trying to get away with selling a used product as 'open box').
I agree with listing as Used, then include Open Box in the title, prominently in the description, and also in the Condition Notes. Bold text in the Description.
I've sold a lot of open box goods at work - mostly because little care was taken when the retail shelves were emptied (I work for a liquidator) and the boxes were damaged enough that we had to open them to ensure the product was intact and still working. Your use of pictures will also help calm concerns about 'open box used', at least for buyers who know how to shop and not just how to consume. 🙂

Common "New" definition: "New: The item is brand new, unused, unopened, undamaged, and in its original packaging (where packaging is applicable). Packaging should be the same as what is found in a retail store, unless the item is handmade or was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag. I would also add that batteries are not guaranteed to work. That is a biggie on battery operated items that have been on a shelf for years.
As others have said. It is not new. It is unused. And yes, I do know that is not an option. It just has to be clear in photos and title and description what you are selling. I would never select new on such an item.

I always select USED as the condition and then put "New Open Box" in the title in situations like that.

Are you listing it in the proper category?
What category are you listing it in? Health & Beauty has Open Box as an item condition.

You have the item listed as "brand new" (which according to item specifics is "unopened") but description contradicts the IS. IMO, that's looking for trouble!

That's my situation. I think for this type of item I'm only allowed to mark as "new" I put "open box" in the description but will play with the category as @fab_finds4u suggested

Yup, I noticed that it was the only option. I just don't know if or how you'd argue a NAD claim for the inconsistency. (This isn't to imply that you can win NAD anyway, but it's an interesting dilemma.)

Appreciate all the input everyone.
I did find that in certain categories in the health and beauty even related to skin care I can find "open box" categories. Unfortunately they aren't the best description of the item but from what most are suggesting I shouldn't list as new and will move forward on find a semi appropriate category.
