Yes you can.

You can END the buy it now, then relist it, and change it to auction., but you will get a 'ding' for ending the listing---which is not fair because ebay forces you to accept the new rules for buy-it-now.

I end listings all the time with no ding.
Could you post where we can find this new rule

You will definitely not get a 'ding' or bad mark against your account for ending an unsold listing (Buy it Now or Auction). I probably do this once or twice a month as I rotate stock.
