I can't be sure if I'm very knowledgeable about ebay's non paying policy as I find it confusing and contradicting.
So I hope I can ask you other ebay members how or what I should do with a buyer that is not paying.
It's not just that they are not paying, they are also not being honest with their messages, and I really just want to cancel the order before they pay. Because my gut tells me so.
It's been 2 days since they accepted my counter offer. Can I cancel the order without getting a defect? and
can the buyer still give me a negative FB?

Cancelling a transaction at the buyer's request will not be a defect on your account--be sure to use that as the reason. A buyer can leave feedback, but it would qualify for removal since they requested the cancellation.

If the buyer did NOT request that you cancel, then you WILL get a serious defect against your account. Ebay allows the buyer to protest your cancellation. And he will be able to leave feedback.
Perhaps if you tell us what the buyer is doing, we can give your further suggestions or information.

I just had a similar interaction with a buyer where I sent an offer, at a price requested by the buyer mind you, and then over the course of the next 24 hours it became clear that this was a buyer that spelled trouble. Alas, there is no good way to handle such events unless the buyer writes something to you that can be interpreted as requesting a cancellation. Fortunately for me the buyer never actually accepted the offer and I ended up removing the listing after I had blocked the buyer and the buyer came back within an hour under a new ID. In Ebay's puerile corporate mind there are no bad buyers until after the fact and they leave it up to us sellers to clean up the mess. We are the people in the parade who follow behind the horses with the bucket and shovel.

If you cancel an order without the buyers request they can leave you negative feedback and eBay can give you a defect. If 48 hours have passed you can open a unpaid item claim. If they don't pay the buyer gets a strike, and the case will close with your fees refunded.

Put the buyer on your blocked bidder list now.
After 48 hours file an unpaid item dispute. If they don't pay then 4 days later close the dispute giving them a strike and get a credit on your fees. The buyer won't be able to leave feedback.

ok, but I got question about that.
If i cancel the order, ebay will relist the item. It will be the same listing # as the listing that was canceled.
So how can the buyer leave FB on an listing that is active? So when someone else buys it, they will be able to leave FB. Can one listing have 2 FB?

As mentioned, to cancel without a defect, the buyer must request it. If you relist after cancelling, it is not the same item number.

Why are you replying to a thread from 2020? Why do you want to cancel the transaction? You should start a new thread, and specify (1) whether the buyer has paid yet and (2) how long it has been since the item was Sold.
