Does anyone know if sellers of used items have any liability on Prop 65 warning? I looked to California law and it is for noting carcinogenic or birth defect causing chemicals in your item. I think there is nothing to worry about in selling used clothing, but it would be nice if there were some info attached to the box for sellers to judge. In California they can fine you $2500 for not posting a warning. Do we have to worry? Is eBay going to put up specific boxes pertaining to laws in each of the 50 states?

I just read on another thread if you have less than 10 employees it does not apply to you.

worry? no.... BUT do you now list anything that might be "bad" for anyone ...anywhere?
do you know if and what any of your items could be a cancer causing..hazardous to helth item?...AND wouldn't you make note of it..if you were worried about others?
SO why not decide to add a note to your listings saying " nothing of concern" or "this might have something that could kill you if worn"....???

Oh sure. Just put it on everything just to be safe; which then makes it completely meaningless; like crying wolf non stop 24/7/365.
People need to grow a pair and start giving the finger to anyone trying to exert any authority over them that they have to reasonable claim to exert.

Yes, common sense as it was suggested to me elsewhere. would dictate that so long as you didn't chop up that car part, put in your stew and serve it to your kids to eat for dinner, it is not likely going to be a problem.. Maybe eBay will let us exclude California as a shipping destination? or perhaps use their search manipulation technology to simply not show such items to users in California.
