CBD....

Hmm...I wonder if there will be any changes to the CBD listing policy with the recent changes to the Farm Bill.  I would certainly hope so.

Where are all of you getting your information???  That is just wrong.  It has been removed from that list and is to forever be considered an agricultural commodity.

I am happy  Smiley Very Happy  to say that you are correct now as the 2018 Farm Bill became law 12/20/18 and takes effect on January 1, 2019.

 

"The hemp-specific provisions of the 2018 Act amend the federal Controlled Substances Act of 1970 so that hemp plants containing no more than 0.3 percent THC are no longer classified as a schedule I controlled substance under federal law."

 

 

The DEA has lost control of regulating hemp!!

 

A DEA directive says:

“Such products may accordingly be sold and otherwise distributed throughout the United States without restriction under the CSA or its implementing regulations. The mere presence of cannabinoids is not itself dispositive as to whether a substance is within the scope of the CSA; the dispositive question is whether the substance falls within the CSA definition of marijuana.”

 

The DEA still regulates the Marijuana Extract Rule, and still considers CBD products with higher THC levels a schedule 1 drug." (on a federal level anyway) although is not enforcing this in states that are allowing marijuana sales.

 

The Act does not federally recognize non-licensed, non-commercial hemp cultivation activities.

Obviously you haven't read the bill.

 

This article is a good summary of the impact of the Farm Bill as it relates to CDB. Bottom line is that it remains highly regulated at the Federal level.
