Buyer trying to scam me, any thoughts

So I have a buyer who bought a sony handycam from me. They wanted it shipped that day and I did. We live in the same state so they got it within a day.  Upon receiving it they sent me a message saying it was damaged.  .  I replied that I wanted pictures of the damaged box so I could start a case with the post office and offered my apology for the damage. I quickly received a negative and was accused of sending the wrong camara. They sent me pictures of a damaged camara with different serial numbers. (this was the only camara I had for sale). I take pictures of serial numbers on all items.

They sent the camara back to me (the wrong camara) and looking at the damage I saw that the camara bag had no damage, It looked like it was dragged on the floor. Ebay is taking a long time to review this case and I hear horror stories about the buyer is always right.  I've been doing this for 22 years and they have been on for only 2 months.  This is a $165 sale.  Any thoughts?

That is Exactly what these scammers do when they cannot get a case won through ebay. They then go to te credit card to steal the merchandise. You need to do a dispute with the payment processor and ebay will assist in that. You need to provide as much info downloaded into a file for ebay showing the serial number discrepancy for sure and any other info pertinent to this case. Fight it!

If this were me, I would have tried to file an insurance claim based on the damage report but if the buyer would not submit photos of the damage it might have been difficult to file a claim with the PO to get your claim approved. THIS being a very very bad practice on here that ebay does not require a photo from the buyer so te seller can submit this claim.

So if you have the photos of the damaged parcel originally sent in a photo’s from buyer. Go ahead and file the insurance claim and see if they will approve it.

With the picture evidence the OP has, I would actually file a Police Report before appealing the Chargeback.  That way they can also submit the Police Report number.  That does have impact in cases like this with Ebay.

Sound like the buyer was looking for a free replacement of their own device or even worse. Meaning they could be buying junk elsewhere and then getting online to try to get a working replacement for free and reselling. Who knows!

 

You caught them at their game based on serial number. eBay should make an easy quick decision on this and flag or even suspend the buyer for false claim. 

 

You requested photos of the damaged package and they refused. Damaged packages are normally delivered with tape marking it damaged. HUGE RED FLAG!

 

Electronics are a target for scammers who have no ethics. 

 

1. Don't let a buyer tell you when to ship. 

2. take photos of the packing process and the final package with shipping label. 

3. ship with signature required if needed

4. Google map the buyer's address

5. review the buyer's profile and all feedback categories. I find it interesting at times when a buyer has about 50 positive feedback from sellers, but they have left zero feedback for sellers.

If you shipped with tracking and show delivered, shouldn't you be protected by eBay?

 

What claim could they make to their C.C. other than they don't recognize transaction? I hate that poor excuse! I hope the C.C. and other payment vendors are keeping record of these claims by their customers and connecting the DOTS.

I did manage to get the negative removed. 
E bay has upheld their decision to do nothing and wait the cc company’s decision.  This seems like an easy decision for E bay to make in my favor (you would think). I guess 22 years vs 2 months means nothing.

They cannot override the process once the credit card chargeback has started. Ebay has to wait for their decision.

The fact they sent photos of a camera with wrong serial numbers will help you. Its evidence.  Evidence of fraud.  Make sure you point this out to the ebay fraud people when you discuss this.

 

I would also go through with filing a police report and filing a fraud report with usps.  Get the ball rolling and  make ebay aware you are filing both.

Congratulations on getting the FB removed.

 

Ebay can't make any decision for the CCC, which is why they aren't doing anything at this point.  However once the CCC makes their decision, you can appeal it.  

 

You have received some great advice on this thread, but I'm not sure you are reading it, so I'm not going to repeat myself unless you tell me there is something you don't understand.

Did they?  The OP didn't say that.  They said they have the pics, but I don't see where they said they submitted them on the claim.

 

Now on this thread I encouraged the OP a few times to get their evidence together, file a police report and get all that info in evidence on the appeal.  I'm not sure the OP is actually reading the thread or has noticed that they have received some great advice.

Thank you. I have read all advice on this. I know it in the cc hands according to EBay. However I feel EBay should have moved sooner with this buyer. They can still buy and sell.

It isn't "according to Ebay", it is how Chargebacks work.  Ebay has no say in how they process a claim.  None.

 

Moved where?  Do what?  Ebay an NOT make a decision for a Chargeback from a Financial institution.

 

Questions have been asked on this thread that you have never answered.  Did you submit evidence with the original Chargeback regarding the buyer switching the product?  Did you submit all the pics of what you sold and what you received back?

I see the neg has been removed. Good.

I suspect that while the eBay case is ongoing, that you should contact USPS about mail fraud, since you have some proof of the switch.

 

Add in the Small Claims court case. Those cost very little to file and you don't need a lawyer.

DD was involved in one a couple of years ago and British Columbia where she lives has move to online hearing of the cases which simplifies things since she didn't have to make time to actually appear in front of the mediator.
