Buyer/seller using stolen images to sell handmade OOAK item they do not have

Hey all. So what's to be done about sellers like this one? Reporting the sale doesn't seem to do jack.

The mask pictured was handmade by an artist who isn't the seller and what's more, she only made one and it isn't even for sale according to her blog. Her costume heads sell for 1000+ a pop, not $25.13! I found out that it's a bait and switch - buyers get a Dollar Store quality knock-off that looks nothing like the one pictured. Seller has quite a few negative feedbacks.

This really ticks me off.

What's to be done?   Don't buy from that seller.

The artist would have to become a VERO member, then report the listing in order for Ebay to remove it.

If Ebay removed items solely on reports from random users, nothing would be left for sale because everyone and his brother would be reporting their competitors.

The easier you are to offend the easier you are to control.

I looked at the two sets of images. They are not the same. The images on the deviant site do not appear to be the same images on eBay. There are multiple listings for this mask on eBay. All are Chinese sellers, all in the same price points, using the same pictures. The artist’s mask is very similar to the eBay mask but i do not believe they are one and the same. The pictures are different.

If you are not the rights holder of the creative work, there is little you can do. You have reported the suspicion—i would let it go at that. But i would hesitate in the future to incriminate a fellow eBayer without proof.

If the mask being sold is a cheap knock off .... then the seller will have to deal with the consequences  (unhappy buyers).

Seller has quite a few negative feedbacks.

Yes, seller has a lot of negative feedbacks but they don't appear to be from this mask, rather they are from other unrelated items.

Probably because those masks haven't been delivered yet. That listing started on October 13 and currently has an estimated delivery range of  November 30 - December 17. With an estimated delivery over 30 days after purchase, we can expect to start seeing the negs for that listing some time in late November.

Even if there is a violation of intellectual property rights here, it is not something you can do anything about.

If you believe there is a violation, then you should advise the original creator of the mask to sign up for eBay's VeRO (Verified Rights Owner) Program.

A VeRO member's reports get immediate attention.   No one else's does because eBay cannot know the motives of the person making the report.

If the original creator of the mask does not care to sign up for VeRO, then so be it.

If you click the video link in the Deviantart post it takes you to a YT video the artist made to demo the mask's moving ears and jaw. The images are screen grabs straight from that video. Absolutely the same mask

Did you buy the item to verify that what you purchased was the item the seller listed If you did not buy the item you have nothing to go by and there is nothing to report.
