Buyer fraud

hi all good seller,

 

Please be careful with the fraud. We sold the porcelain set and it is from our family. We post " look like new" because we used two times and put in storage for many years. It is a rare set and we sold only half of market price.  When receiving items, a buyer bought it and claimed that the posting not same as description because plates have gold loss not look like new. We asked for proving pictures and be provided with 4 plates and two cups that have gold loss.  Then this buyer asked us to refund $200, almost half of selling price. Then even worse, the buyer made up  story about more than half of the set have gold loss.  We knew the set very well and in details. We pulled out the set and packed one by one when we ship. We took a picture of them and even felt bad when we sold them.  We knew the set in details and have all pictures of a set in file. We disagreed about asking refund of $200 as we told the buyer and told the buyer that we accepted the returning items, and provided the returning shipping label and waiting for items back.  However,  the buyer still does not want to return and kept insisting that not in description. Within that afternoon ( the same day that buyer opened the case and we accepted the returning and providing shipping label), the case is closed and the next day, we received an email to inform that ebay refunded the money for that customer. How can eBay allow these fraud buyers? If so, eBay encourages them to buy rare items from others and just do that for free? Even seller accepts a returning and they still do not want to return and still keep them for free money... How can this buyer can get free money with the value set in hand even without passing the limited time for the resolving case, and even we resolve the case right away when we smell the fraud from this buyer????

I did read your entire post, but am confused on one aspect - when the Buyer filed the claim, did you "accept" the return and send the Buyer a label to return the item(s) to you?

I agree with kat, this doesn't sound right at all. If you accepted the return and provided the shipping label, I don't know how Ebay just gave them the refund and let them keep the items. Very strange. Hope to hear more details on this...

Thank you very much for your email. The buyer filed claim yesterday and just gave us one option: to refund money of $200 . We disagreed, and accept the return yesterday and provided the shipping label as the same time as we clicked accept the return, because we know for sure that our set is not as the buyer claimed. Then, we saw status shown waiting for shipping return. Next day, it gone, and eBay message shown they refunded money for that buyer

and I forgot to mention, after we accepted the return, and received email from that buyer and  she mentioned that did not intent to return. Then we got message from ebay next day that they refunded the buyer full amount without impact to us. However, I felt so strange too.

That means you lost nothing. Ebay gave them a curtesy refund out of their pocket. To be honest I am very surprised Ebay forked out $200, it sounds like a lot for Ebay to just give in like that.

This sounds like Ebay provided the refund to the buyer and is NOT making you pay for it.

 

This sounds like you keep the money paid to you, and the buyer keeps the plates & gets a refund (Ebay's expense)????????

$200 was the partial refund buyer requested/demanded.

 

According to OP this is "almost half of selling price".

 

If ebay gave a full refund as OP said, they paid out a lot more than $200...

Sorry, but the gold loss is clearly visible in your own photos. 

 

It was a mistake to call the set "as new", and it was a mistake for the buyer not to examine photos closely.

 

However, the buyer was in the right to make a NAD claim.

Thank you earthdreamer. Yes, the photos shown that and we told buyer that.  The buyer claimed NAD. We  offered portion of refund for these plates, but buyer still insists to have $200. We disagreed and we thought it was better to lost money on returning shipping than stressing out to deal with not honest buyer. However, when we sent the returning label and accepted returning the same day of claim, buyer emailed to us many times and said buyer did not want to return. Then the case closed today with that message and we also got negative feedback from that person.

Jesus that's a lot of gold loss. Should not have been described as "new" ever. Buyer should have looked at pics but seller didn't describe it accurately at all. 

 

Still shocked ebay refunded.

The negative feedback is a hard lesson. 

 

Even though the buyer ended up keeping the dinner set for free, you also did not suffer any monetary loss. 

 

Apart from the negative feedback, I believe the result of this transaction was fair for you, though I understand it must rankle that the buyer used the system to gain the most,  namely keep your prized dinner as a "gift" from ebay.
