Buyer Wants Refund for Item we didn't list/sell/ship...

We're not entirely sure what to do about this.

 

We listed and sold a pair of inline skates. Got paid and shipped them. Now we receive a message from the buyer telling us that they want a refund because they were listed as being a Size 12 and the buyer claims that what they received was a Size 9. We checked our listing (and the file of photos originally taken for the listing) which show two labels showing that they are a Size 12.

 

We asked the buyer to send photos of what they received and their photos show the same make/model of skates with labels saying they're a Size 9. However, one of their photos shows a different logo on the side of the skate to what our photos show. Obviously not the same skates.

 

Since we only had this one pair of these skates to sell, and all of our photos show them to be a Size 12, we're guessing that this is some sort of scam. That the buyer already had a pair of Size 9, wanted a pair of Size 12 and are trying to get us to accept the "return" of these 9s while they keep our 12s and get their money back.

 

If we accept a return and they return a pair of Size 9s these are not what we listed, sold or shipped. So how do we deal with this situation?

I'd certainly approach the buyer to see if she has your item confused with another item, if she denied, I'd call ebay and ask them to check to see if she's bought any size 9's.....

Here is what is happening - the buyer used to be a size 9 and now they are a size 12 so they are just going to trade skates for the new season.

 

OP, here is the problem.  You listed and sold the item on ebay - while it is oddly phrased in ebay's UA, once you have listed an item on ebay, ebay has total control over what happens to it and the money you get for it. 

 

You have a return policy, so you must take any return or lose the money or the item anyway and get a defect for your trouble.  And it doesn't matter what the buyer returns to you, there is no appeal anymore.

 

The best you can do is call ebay and hope that you get a CS that understands (hint, if you get one with even the hint of an out of country accent - they are worthless and will do you more harm than good and it will not be reversible) OR you can tell the buyer that you did not send them a size 9 and that the logo in the pic is not one you ever owned and that you will be filing a rifled mail report with the USPS and a theft report with their local police because someone switched out the skates and they will investigate.  And hope that the buyer will go away or that there are enough of reports to the PO about the buyer that they will do something about it.

Not very likely but...It might scare someone. I think It should be reported to the ICS also. which is a federal offence. I would report it anyway. If this case is Not cleared up!  It is not just a threat it is a given that I would report it.

 

Small Local Law enforcement in OUR area has the time to look into problems like that!

Most times - just the thought that they will be on someone's radar is enough to make that person retract their req and go away.

We only just got the word from eBay after it was escalated to us requesting they make a decision and they found in favor of the buyer, of course, even though he's so obviously scamming us. However they did point out that he must return the goods before he's issued a refund but, of course, unless he returns a pair of Size 12 skates whatever he does return will not be what we sold or shipped and we'll take it from there...
