Buyer Fraud

I had a buyer claim that I sent a book even though she sent a picture of the package *STILL SEALED* and there is no way that she opened the package to see that I did ship the iPhone.

Will eBay be on my side disputing this? If I have to pay for the buyer to return a book that would be extremely unfair.

I would be out $150.

It looks like that photo is from the freight forwarders camera.  She does not have the package yet and the freight forwarder may have listed it as a book for duties or something.  To me, she is saying the email notification from her freight forwarder says it is a book.  This is good for you that she has sent proof that she is using a freight forwarder, her eBay money back guarantee should be null and void.  Does your tracking number show delivered?   Here is a link for the money back guarantee, scroll down to "not covered" to see in regards to freight forwarding.

This is the way eBay customer return requests work:  if the buyer says s/he received a book, then eBay believes s/he received a book. eBay expects you to accept the return, provide a return label, and refund when you receive the item.

Ok, what if I receive a book back when I sent the phone?

Am I out of luck?

This really seems that buyer fraud is really easy to get away with on eBay.

Yes, you are out of luck, and yes, buyer fraud is really easy to get away with on eBay; however,  I choose to believe the overwhelming majority of buyers are honest. You ran into one who isn't.

I didn't check your listings, but if you are (or become) a TRS and offer 30-day or longer returns, you'd have these additional protections:

That is a fantastic observation.  I'd take it a step further.  I would suggest the OP contact the buyer and ask them if they are assuming it is a book as the package appears to be unopened.

If the package is still at the freight forwarder's address then the return label that the seller would issue from the INAD would be for that address.  If the freight forwarder returned the package to the OP, the buyer would be entitled to a full refund per the Ebay rules.

If the freight forwarder already shipped it off to the buyer, that is when the MBG is no longer applicable for this buyer.
