I've been dealing with the following situation for the past 3 months now and have no other options now besides requesting forum advice.
I sold an item of high value, and back in January the buyer filed for a return claiming the item was "defective". I initially tried to help the buyer with his purchase, given it was new and sealed when originally sent out, but no reply. I'm moderately aware of ebay policy, so I accepted the return. Instead of the original item, whose size and weight I have pictures/documentation of, I received a small box that weight next to nothing. Given the current COVID situation, the package was shoved in my mailbox and signed "Covid" instead of actually getting my signature.
I immediately reached out to ebay and the agent opened a claim, instructing me to obtain a police report. I planned to very soon, but the next day I was notified that a case had been escalated by the buyer, and subsequently closed in their favor (IN SECONDS!). Outraged I gave them another call, and was told my only option at this point was to appeal. Given I needed a little more time to gather all my information and obtain the police report, I opted not to create an appeal at that time. Before I could even get off the phone with this agent, I received an email saying an appeal was created for the case decision and closed in the buyer's favor. I SAID I DIDNT WANT TO APPEAL YET! They even violated their seller policy by not allowing me the full time period to respond to the case.
Since January it has been nonstop phone calls and complaints with ebay agents, some sympathetic some not. I have uploaded every document asked of me, filed and sent the police report, and signed an affidavit affirming i was not returned the item I originally sold. Twice now I've been told the case was sent to the "manual corrections department", but I haven't heard back from them in the given time frame. Every time an agent sends it up to a supervisor I get the same generic reply: "It looks like over 30 days have passed since our final decision. 30 days is the maximum amount of time allowed to resolve a case in the Resolution Center; then, after the case is closed, you have 30 more days to request an appeal. Because it's after this second 30-day time frame, we won't be able to accept your appeal. We understand that some situations can prevent a timely response, but please keep in mind that these time frames are for the benefit of both buyers and sellers. The 30-day limit on appeals allows us to be sure we're being consistent, and thus more fair, with all of our case decisions."
The buyer is of course not responding knowing what he's doing. The negligence of ebay is unbelievable and I could really use some help here.

Boy, that is a nightmare. You have a scrub buyer who played the system. I can't even offer you much hope. Godspeed.

If this were my issue I would pay a lawyer $200 to write Ebay's legal counsel office a letter and see where that goes. If it looks like you would escalate to a lawsuit and you have a valid case they would make this go away...

I'm sorry to hear what happened with you. I hope you still have access to your seller hub; If it's a very expensive item, provide the buyer's contact details to the Police. Perhaps they will inform the Police station where your buyer is. If you are planning to meet the buyer in person, make sure to contact the Police station first.

I wish you would have come here first to have saved waste time pursuing eBay. I am afraid there is not anything eBay will do for you here. You got scammed and eBay should have allowed a proper appeal without ramrodding it thru the way they did. Even if you had been able to appeal, there were no guarantees eBay would have reversed the decision.
Tho a lot of time has past now, i would go after the buyer, not eBay. The buyer perpetuated the fraud and you could sue them. Initially, you might have a lawyer send them a registered letter outlining your intentions and making them aware you will seek full compensation and leave no stone unturned, unless you get your item or the funds returned.
This includes going to the postal inspectors as it is a felony to use the mail system to defraud. It also means registering a complaint with the Internet Crime Complaint Center at ic3.gov. (Be sure to always get case numbers at each place, to build your case.)
You didn't mention the actual value of the item. What you do moving forward depends on whether or not it is worth it to pursue the matter further.
My hope is that the fraudster won’t want the authorities to be involved and therefore will capitulate to your demands.

I am from nj and the buyer is from bronx ny. Apart from a shipping address I dont have much information about him/her (i dont know if the name is legit).

A similar situation happened with a photographer selling her $1400 camera; She posted the story on her facebook & eBay ended up helping her out. I wish you luck. God has a plan & will open other doors for you if this doesn't work out. God Bless

Did the "buyer" use the return label that you sent?
Please read here, and see if anything in the scenario sounds familiar.. i.e. international buyer with a US shipping address, etc.

We get orders from (2) freight forwarders in the Bronx quite often - one is on Fordham Rd, the other Beach Ave - perhaps the address is a freight forwarder?

Yes they did, and even on the carrier details of the shipment the weight of the object is less than the weight on the initial shipment i sent

My loss totals 1600, since ebay took additional final value fee and charges from me as well. I have definitely thought about going legal, but i’m not familiar with the proper avenues for this type of case.

@nowhus-96. Just tagging on to @fashunu4eeuh. as there is some good advice here.
This is precisely the reason posters here discourage new sellers from listing high priced electronics. Your bidding history on this Red Devil thing shows shark infested waters all the way to the top. The top scammer won the game. Ok it's over, ebay didn't help you and your out over $1600.00.
File a police report in your city and in the Bronx. File a report with the internet crime complaint center like fashun stated, then file a mail fraud with the USPS.
You can get free legal counsel somewhere and ask for advice, it might even behoove you to obtain a lawyer over this mess.
Man, I wished that this didn't happen to you and best of luck out there in Jersey.

Holy WOW! You were SCAMMED indeed. With a few sold items under your belt, and then you listed a few HIGH value and highly desirable items.... you were a magnet for a SCAM buyer licking their chops, especially the
"NEW - PowerColor Radeon RX 6900 XT Red Devil Limited Edition, 1 of 500 Made"
that you listed and the high SCAM bidder won for $1600.00
I myself would personally move on and use this as a learning experience. Hiring a lawyer cost money. Police have their own problems, and your type of incident is at the bottom of their priority list as in perhaps tossing the police report into the trash.
Like some sellers say, never list anything you can't afford to lose.
Sorry about that, I guess I can count myself LUCKY. I sold high price performance lappys averaging $900 to $1500 on up back in the mid 2000s, and never had a scam, but I had experience and sales on my side. But today's climate is different, and I would never sell any lappys or any ultra high value item like the graphics card you sold, even with 22 years experience under my belt.
