Just when I thought I'd had all the tricks played on me I got a new curve ball. I sold an item and the buyer never paid for it. After the appropriate time I filed the "non paying buyer" form and returned my item back to inventory. Today the buyer opened a case against me for not sending them the item they never paid for. Ebay confirmed to me that the buyer had never paid and that I filed the proper report, but it still says "waiting for buyer reply". Now really? This case should be immediately closed as it has no merit nor ever did. Yet the buyer is asking me to either refund money they never paid or to send the item. I really would expect some eBay support here as the facts are indeed the facts. But so far the case is still open.

@tdebuys If I were you I'd be on the phone to eBay insisting to speak to a manager or someone (some dept) that would handle things like this. I can not get over how outrageous it is that they are sending you notification to send or refund when this buyer hasn't even PAID! There is a disconnect somewhere and you need to bring this to someone's attention. Don't bother with the first line CS who answers the phones -- though don't seem to know very much -- insist on speaking to a manager.
Call now and you may be able to get an English speaking rep in TX. Follow up here and let us know how it goes. I am very interested in hearing.

So it looks like Ebay is giving them extra time to get the item. They opened a case because maybe they want the item now. Maybe they wont pay for it again. Maybe they are so naive that they think money back quarentee includes not paying for the item. LOL and more.

I guess the buyer could now respond by saying they want the item. I wonder some times if competitors would do this to get your item out of view for a bit. Lots of interesting games played here.

Like Emerald said you have to close the case yourself in the RESOLUTION CENTER under cases open. My goodness I'm shock at the numbers of seller that just don;t know how to call Ebay on the Phone and even have the case closed over the phone. I know sellers that ACTUALLY LOSE ALL THE THEIR FINAL VALUE FEES to Scammers. I can never have enough blocks on my account... I think people are asleep and hung up on SOCIAL MEDIA ?

Had another thought here. If you waited the approppriate time, filed the non paying bidder thing. How were they even able to open the case in the first place. Wait, I think they have a certain time to respond to the non pay issue? So, if they want it they have a second chance to pay you.

Double check your listing email pay to info, a simple typo there,
If this email field does have a typo, the payment would be in PP limbo.
But you would never see it, stranger things have happened.

Now that i remember I had a similar issue like this person and I did a thread here and got fed to the wolves. What I did is hit CANCEL on the item and choose SOMETHING WRONG WITH ADDRESS... The case was closed on the spot and got my final value fee in seconds. Block the buyer next. That worked for me on this type of case. But then again i did an evil thing and might get a defect. I will gladly take a defect which I did not then deal with a SCAMMER.

I seem to recall a thread where a blue said that if a buyer opens a PP claim,
it closes any ebay claim.
My only non payer, I filed, but I forgot to close it out 4 days later.
The guy never paid, and ebay auto closed it the next day.
So yes after a non pay is started, the buyer has 4 days to pay.
This is not the first report of non payers filing INR.
it's ebay... a new glitch every day...

Yes I MANUALLY closed the case when it first became available to close it. I called eBay when I saw what was happening with the buyer and they assured me the buyer could not win the case. THEN this morning I get a threatening note from eBay that I MUST ship or REFUND the Buyer immediately to avoid further action. NOTE: BUYER HAS STILL NOT PAID.
GIVE ME A "BLANKETY BLANK" BREAK. THEY NEVER PAID, EVER. AND TO THE SUGGESTION FROM SOMEONE THAT I MIGHT HAVE MY PAYMENT ADDRESS WRONG.....IT'S BEEN WRONG FOR TEN YEARS IF THAT IS THE CASE. I HAVE REC'D PAYMENTS BEFORE AND AFTER THIS INCIDENT SO I HAVE A HARD TIME THINKING IT WAS THE ADDY. I thank you for that idea though because it could happen I suppose.
I sent notification to the buyer and they do not respond. ONLY EBAY is RESPONDING with threats. This is not big $ but it infuriating because it keeps escalating even though I've notified everyone.

Because eBay says they can open an INR even when a UPI is opened and closed without payment. Trinton confirmed recently that this is still the way the system works after all these years. 😞
