Hi,
I have a question about the return policy.
I sold a set of golf clubs (brand new, direct from manufacturer), in February. They were exactly as described but on day 31 since the actual delivery, the buyer decided to claim he wanted a return because they weren't as described.
The buyer received the package (confirmed by tracking on Feb. 25th. (Days 25,26,27,28,29)
The buyer opened a return request on March 26. Days (1-26)
For a total of 31 days.
Opened up a dispute with ebay and of course they sided with the buyer. Obviously i have an issue with the fact a buyer can return something that diminishes in value as soon as it is sold (Car, golf clubs, etc.) But I have accepted this issue because ebay has found loopholes to agree with a buyer, such as claiming the item is not as described. It is a shame that they don't help protect sellers at all, which will not be conducive to long term development of the company. It is a very short term outlook which will catch up with them by losing peoples trust. That aspect is starting to compound because I was briefly aware of issues before I decided to do business on ebay.
My main question and topic of discussion is how do I go about appealing a decision of a return when it clearly is outside of the 30 day return time-frame (Buyer opened a return on the 31st day)? ebay has admitted to Days Feb. 25th-March 26th and then back tracked to saying it arrived on Feb. 26. Although I have the tracking and delivery confirmations.
I have asked a friend (lawyer) what he thinks and he said it is clearly a breach of contract cause of action. I am only looking for ebay to rectify the mistake on their end and rescind the charge to me. I know they do not want to go through the hassle so they have stopped replying to me.
Any suggestions would be greatly appreciated.

I believe this means the day it was delivered as day 1.
720 hrs in 30 days and this is happened after 720 hrs from when it was delivered.

I'm not going to count the hours, but the 1st 24 hour period would end on Feb 26. The entire day, Feb 25 can not be counted.
The eBay system seems to be pretty good at counting hours. ( not saying it is always right)
We often see posts where a buyers return time runs out at 120 hours. To the minute.
It does not seem that a INAD return would be able to be opened beyond 720 hours after the actual (to the minute) time of delivery.

When calculating the number of days between two dates, you don't get to count both the "beginning" date (for lack of a better term) AND the "ending" date. You count one or the other.
Either way, the number of days between February 25 and March 26 is 30 days. Period.

So, your buyer was with his/her rights to file the claim on the 30th day, and eBay was correct in siding with the buyer.
Next time, make sure you consult a lawyer who knows how to calculate the number of days between two dates.

So the return policy is not run like the listing policy for items with ebay?
Listings end in whole-day increments from the listing’s start time, so if you submit your listing at 1:14 p.m. on Sunday and select a 3-day listing, it will end at exactly 1:14 p.m. on Wednesday.
This is what were assuming.

Day 1 of the 30-days-to-request-return is the 1st day AFTER delivery, day 30 being 30 days AFTER day of delivery, and, with ebay's bias toward favoring the buyer, probably not expiring 720.00 hours after delivery, but as late as midnight Pacific Time on the 30th day after delivery day. (That is my expectation of ebay's position on expiration time, but I don't know for sure.) But, I do know that, with 29 days in Feb 2020, the buyer receiving a package on Feb 25 would have his request for return accepted by ebay on March 26 as within 30 days.
This is why I rarely leave positive feedback for a buyer until either after 30 days from delivery or until I am provided positive feedback. I've seen ebay honor too many unwarranted return requests, resulting in unwarranted refunds at my expense, to want to also reward buyers with unwarranted positive feedback. Yes, I know my lack of feedback does not hurt the buyer, since sellers can no longer post negative feedback, and, yes, I know that a buyer can still request a return after my posting positive feedback. I just don't want to be a part of recklessly rewarding buyers who are still in a position to be able to practice abusive returns behavior. ebay officially allows what even they recognize as abusive returns behavior up to 3 times per year per buyer. I'd be delighted to be corrected in my understanding if they have recently changed that policy.

If you want some advice: STOP WATCHING THE GET RICH QUICK DROP SHIPPERS ON YOUTUBE AND START SMALL. If you do not do this, I hope you have a very large bank account to burn through with problems like this.
