return one of two items from one order?

I bought two items in one order.  Both advertised as used and the description even described them as operable.  One is completely inoperable.  Seller's listing says he doesn't accept returns, so I expect trouble.  When I do an INAD, is there a way to just return one and get half my money back, or am I stuck returning both.  I don't think I would just trust seller's promise to give me half the money unless there is some way to enforce.

That's up to you. If I were in your situation I would say the following:

 

Hello- I just received the items, thank you. I'm sorry to say that one of the items is inoperable and both were described in your listing as used but still operable. It's a shame as I really wanted them. How would you prefer to handle this? 

 

This is open ended and allows the seller to decide which way to handle. You aren't asking yet for anything. See what the response is. Most likely they will offer you a partial refund and you can then accept. You will receive the refund shortly afterwards.

@kssteve If you open a return, it will be for the transaction itself. There is no way for you to specify keeping half of the order. However, you can first reach out to the seller and work out a deal with them. Regardless of their not accepting returns, if they are a smart seller, they will work it out with you. It may be easier for the seller to issue you a partial refund for the one item and avoid having to pay return shipping for a broken item. I suggest you reach out kindly, just like you wrote on here. Explain your situation and then leave it up to them how you should proceed. If seller says return for refund, then just do that and move along. Best of luck to you....

Just to be clear, I should suggest a partial refund for the one item without a return of the one item?

That's up to you. If I were in your situation I would say the following:

If you open a INAD dispute, you can add a note stating that only one works and you're open to a 1/2 price partial refund. Seller doesn't have to agree to it and if not, he'll be required to send a return shipping label and you'll have to return both. 

 

And if he denies the return request, you can escalate and ebay will decide in your favor. 

 

I think your resolution is very fair.

If each item is from its own listing @kssteve you would just INAD the listing that's inoperable.

But if they're both from the same listing, eBay has already sliced the baloney for you, so just mark the quantity, and the enforced refund of the returned item cost and shipping will be prorated from the total payment.

I messaged him, and he was cooperative. He agreed to send me another.  He's apparently got a huge and unique collection of related classic items that's he's liquidating.  I got a good price on the two, so another is the best possible outcome.

This is good, but keep an eye on this and do not let it go past the time frame for you to claim INAD.

 

Hopefully this is an honest seller, but just pay attention and I would request tracking sent to you as soon as the replacement has shipped.
