You are protected by the eBay Money Back Guarantee: eBay Money Back Guarantee policy

-If you received an item that is not as described, "does not match pictures or description".  You go to the item in your Purchase history and file a return using that reason.  You will get a pre-paid shipping label regardless of the Seller's return policy.

-The Seller will have 2 days to refund after receiving the returned item, failing that you go back to the claim and ask eBay to step in and force the refund.

Unfortunately this is subjective and can be abused.

It can be abused by liars, but how is a policy subjective? It is what it is.

   Ebay did not sell you anything. A seller listing on Ebay did. You are/were protected by Ebays' Money Back Guarantee. 

   The seller will take it back or let you keep it and get a refund in most cases IF you bother to find out how (within the time alloted to do so).

   Ebay (in most cases) will make them refund you.
