So who is in the wrong here?

Bought these at a discount and opened to check them out and make sure they were all good before posting up. All clean and in new condition. Didn't want to mess up the folds on the other underwear so I just put it in the box and took a picture of the box. I was willing to refund fully and gladly. Do you  think this is ok on ebay?

 

 

Buyer: I received the product today , very fast shipping but item description was false . I have bought a few packages of these seperatec underwear over the past month , some new without tags or damaged box as you said in your description . These are washed used underwear put back in the box and sold to me as new . I should have known with no actual picture and a zero seller rating not excepting returns but I trusted you any way to save ten dollars and you sold me your used underwear..... Not cool at all and not acceptable on eBay

I'm sorry, it was not my intention to sell you anything used. If you feel they are used, you are welcome to send them back for a full refund.

 

Buyer:

I appreciate that but I will not take off work just to make it to the post office in there hours open , loose more money for doing so then refund and pay another $10 to get my $34 back when none off this was my fault except trusting you as a seller . I am not being a jerk or unreasonable , I have not contacted eBay , only you even though I know as you should eBay reads all messages before they send them to you or me . Whenever you lied to me and sold me your used underwear as new or you bought these at a great price for resale you know these were used and not new from the extreme laundry detergent smell alone even if you just opened the box to see the colors . I have worn clothes my entire life as I assume you have and know what labels look like after being washed many times . The same underwear , fabic and brand I have bought recently and washed in hot , dryed on hot more then five times do not look anything as what you sold me , if you sold me underwear that you washed and wore five.

 

Buyer:

.... Times I would have been fooled and I would have given you your first good rating product as described which is actually unseltaling as it is . If you want pics of what you sent me I will show them compared to new open box ones I purchased and washed multiple times in the worst settings on hot that look as new . It is not my fault you did not do you job , if you pictured the acutual underwear not the box I would have known they were not new and moved on not putting myself to deal with this **bleep** I do not have time for . Send me a pre paid shipping box if you want you used underwear back and no bad rating , send me a full refund and I will throw your used underwear in the trash and still not give you a bad rating or keep doing as you are and I will take a $34 hit to my wallet and let the eBay community know what kind of seller you really are .

This is not my first account on Ebay. This is literally Feedback Extortion. I cannot just send a prepaid box without going through Ebay. You would have to report item not as described for the item since you say it's used. Then Ebay would force me to pay out a label for you to ship it back. Only until I have checked the item to confirm it was what I sent out will they issue a refund. This is the right way of doing a refund here on Ebay. I've dealt with these kind of situations before. So I suggest you report the item as not described so we can start the refund process for you. Thanks

Look at my eBay history, I have bought at least a thousand items since 2014 and sold a hundred or so. Only given one bad review even though had issues like this at least four times now so far . All of them with new sellers with no ratings or very few which is why some people do not even let people bid with no ratting and only take pay pal for their protection I do not need to make a case to PayPal or eBay for $34 , not worth my time but know I am not trying to rip you off to get free stuff. That is not me at all , eBay knows . I know as well I will throw away these used underwear I was sold and told by you they were new no matter what competence you have and think I am sorry is sufficient for lieing to me and I will let someone else go though this not warning others or giving you a bad rating because $34 is alot here in Oklahoma , maybe not California but in Oklahoma your word is your word which it seems you do not understand You know my terms and eBays which you did not conform too

Like I said, money is money and I understand where you are coming from. But what I just wrote to you is the correct way to get a refund. I can definitely refund you but it has to be through the ebay process. I cannot just refund until you have let ebay know that you want a refund because the item is not as described. I have sold and bought items from ebay since the 90's.
 
Buyer: You made your choice and I gave the eBay community honest feedback from your actions..... If you have been a good eBay member from the 90s you would not have 0% which is now -1% since 2021 and your text as if this was my fault you lied and tried to rip me off I would not take off work to loose more money then the refund because I trusted you as a seller no matter you rating tells me the person you are I knew was true when I opened the package and was hit with the most extreme laundry detergent smell in 40 years of my life then looked at the shrunk up labels showing me this was far from the new underwear you decribed thinking an i am sorry , I did not know as if I am some stupid simp..... There might be many in California but not in Oklahoma sir , miss or whatever you identify as .... Liar is what it seems at first which you show first

The eBay rules:

 

1. The buyer is NEVER wrong.

2. The seller is NEVER right.

3. If the buyer is ever wrong, refer back to rule 1.

4. If the seller is ever right, refer back to rule 2.

 

The eBay money back guarantee ensures that ALL of these rules are strictly complied with. If you haven't opened a "not as described" return already, you need to do so now. eBay will force the seller to provide a return label for you.

And stop trading messages with the seller. You've had the tools to fix your problem from the very beginning - you simply need to use them.

I mean. I was willing to take the refund for it. I just wanted my item back. All he had to do was open a item not as described and i would've paid for shipping and as soon as I get it back i will refund him. Even if it wasn't the same item. The money doesn't even mean anything anymore.. its just the principle. What tools could I have used? I was waiting for him to request refund for item as not described. Or did you mean just completely refund him without getting my item back?

After wading through the wall of text, I was thinking you were the buyer. This, even after you said in your first paragraph that you were "willing to refund". 😳 I think my confusion started with your first statement that you "bought these at a discount" and it just went downhill from there.

My 2 Nagative feedback are from people that did not even open ebay return and requested full or more than half refund and tried to feeback extort the money from me. 

Note that ebay refused to remove negative feedback even thought its feeback extortion and no case open at all.

 

1st negative from buyer who wanted full refund for broken arm of the figure. Note that item was factory sealed and well packaged. Possible that it broke, but why would you now want to return the item if it is really broken?

2nd negative wrong colour cord of 50 year old item. Like come on it was in the pictures.... 

 

Ps. I did not refund anything to either one because no open case, no attempt to return the item.

Actually, you CAN just refund him without his having to open a case.

Given your status as a new seller, you need to weigh the risks to your reputation (FB) if you let this go on much longer.  In other words, is it worth it to you to cling to your principles?

You are right to stand by your return item to refund that is they way iy works here 

Buyer lying to get free item

 

Is buyer aware that seller is  REQUIRED to provide  shipping label once buyer opens claim with eBay. 

As for missing work to go to the post office buyer can request a pick up or drop it off on their way to work no need to miss work to return underwear for Pete's sake I used to leave my packages in my mailbox and postal driver would pick it up on his normal mail delivery route .

So the missing work  excuse is just that an excuse

 

Sorry but in selling you have to deal with all types of buyers . most buyers are great though

its not the end of the world.next time I woud keep it much shorter like return if you are not happy

 

all the back and forth messaging is just needless drama to get sucked into

 

as far as the neg goes its just an opinion and buyers are entitled to it

Yes, I know i could've just refund him but that would mean I do not get my item back. I know its not worth much either but I just don't like how buyers always do this to sellers and just get away with it. Just wanted him to file item as not described and i'll pay for label and return. Since this account is new, yes I understand how important feedback is. I think thats what he was using to get me to refund full without item back. I think thats just wrong and it is feedback extortion. I thought ebay would be doing something about that but they just said nope.

This is definitely a case of feedback extortion, and I'm sorry that whoever works for eBay that read it, or just ignored it, didn't see that. 

I'm not even sure how to give a refund without going through eBay's "process".  I knew how to with Paypal, but this managed payments thing is a whole new beast to me.

In my opinion you were right..BUT you were way to wordy in your responses to the buyer..

 

You should just say "Sorry that was not my intent...Please return for a full refund."

Your buyer has issues.  Most likely, he is wearing his pouch underwear which I don't believe was used and smelled of detergent.  Moreover, he would have opened a case, if this was true.   His motive was to leave negative feedback.
