I shipped out a completely new Xbox and it was tested before shipped out. It worked completely fine. As always things could get damaged when they get shipped. It is not my problem that it got damaged. I really can’t afford a return as the buyer wants one. I am trying to contact ebay but it says their helpline is unavailable. Let me know if anyone knows.

You don't have any choice in the matter as eBay's money back guarantee overrides whatever you want.

Have you tried communicating with the buyer to possibly resolve any issues? If they are not communicating and just want to return it, then make sure to get it back and inspect that it's the same one.

     A bit short on information/details but customer support is virtually useless these days. Unfortunately you are responsible for the delivery of the product to the buyer in the condition it listed as. Did the buyer provide any details on "damage" picture of a smashed package, broken Xbox unit, etc? If so you can file a claim with the shipping company if you had it insured or it was shipped via shipping method like USPS priority mail that includes insurance. It will take some cooperation from the buyer when processing the claim as USPS generally wants the receiver to bring the package into the PO for inspection. If they approve the claim they will keep the item. 

     Both of the Xboxes you sold specified "seller does not accept returns" so you could in theory deny the return but the buyer will probably simply open a NAD claim and you will have to either accept the return or allow the buyer to keep the item, but in either case the buyer will most likely be fully refunded. EBay will see this as a seller said/buyer said situation and they will almost always side with the buyer.

EBAY policy holds Seller responsible for delayed shipment or "damaged" item.    If you insured item you can file a claim for damaged merchandise.

 

EBAY Money Back Guarantee (supersedes "no returns" policy) allows customer to return item by claiming "defective, damaged, not as described, counterfeit" (you will be forced to refund purchase price + shipping BOTH ways).    Customer is NOT required to prove their claims.

 

Don't bother contacting EBAY (they will not help you...they always rule in favor of customer).    Also when you ask EBAY to "step in" you will charged extra $20 and get a defect on your account.

For what it's worth, the refund would be issued from your funds on Hold... you'd not be out of pocket anything.

It is your problem if it gets damaged in shipment.  You must accept the return request.  But the odds are, as a new seller who just sold gaming equipment, that you are about to be scammed.  Odds are you are going to lose both the Xbox and the money.  Sorry, but new inexperienced sellers are targeted by scammers, especially those selling gaming equipment, and Ebay refuse to warn such sellers that they are selling a high risk item. Hopefully you have not spent the funds elsewhere.

All sellers are responsible for damage.  It's your responsibility to package safely & securely to avoid these types of issues. You're a new seller and the first thing you do is start selling expensive electronics?  Ebay will have their eyes wide.  Here's a link to Ebay's money back guarantee.  Since you haven't received any money yet, since you are new, the money will be refunded to the buyer via the funds that Ebay is holding.

Shipping damage is you problem.  It may not be "your" fault. But it is your problem. 
Sellers are responsible to getting items to the buyer in the condition described.

Put yourself in the buyer's shoes.  You purchased a completely new and tested Xbox.  It doesn't work when you get it.  The seller tells YOU it's not THEIR problem that it got damaged and they can't afford a return.  What would YOU do? 

 

All the buyer has to do it open a return, click item damaged or not as described, you will have 3 days to refund the buyer and purchase the return label through ebay (it will be sent to the buyer through ebay).  If you don't do this, ebay will take the money from you, give it back to the buyer, and they will NOT be required to return the item.

You might want to read up on ebay's definition on condition while all this learning is going on as well.

 

Also if you want any chance in saving your funds you need to accept the return and pay for a return shipping label. If you fail this part both your item and money will end up gone. A smart scammer can still game the system but this part is your only hope in winning a dispute.

That is pretty laughable 

 

As the seller YOU ARE responsible if the item is damaged in shipping. secondly, it's YOUR responsibility to get insurance, if you want it, with your shipper of choice. If there is damage in shipment, that's between YOU and the shipping company. The buyer is NOT in the middle of that in ANY way.

 

Lastly, you don't have to take a return. You can simply refund the buyer. If you WANT the item back, you will need to approve the return. If you fail to do either of the options, eBay WILL rule in the buyers favor. They will refund the buyer, let them keep the item, and TAKE the money from you for the full refund. You will not get your fees back if they force a refund, and you will have a demerit on your account for not settling the issue. Enough of those and you will be banned.

 

These are the rules we ALL sell under. Read the MBG, you are just as bound by them as any seller. It doesn't matter if you are doing this to "clean the closet" or you are a corporation selling here. If you can't afford a return, then you need to sell things in a way that there IS NO return, like a yard sale. Any online platform will offer the buyers the same protections. It's the law, so there is no avoiding it.
