I purchased an item that was not working when I received it. The sell is willing to refund my money but he does not want the item shipped back,

Ebay will not refund my money until I ship the item back . I tried to contact Ebay but had no success.

If the seller doesn't want the item returned, they just need to refund you.

If Ebay sent you a shipping label, use it to send the item back.

After the case has been opened for 4 days, you can return to the case and ask Ebay to step in.

Stop messing around, if the seller wants to refund, he could do it immediately on its own, without the need of eBay. 

How long ago was the item received, you can submit an item not as described claim on eBay up to 30 days of arrival. Seller will have to respond & submit a return shipping label, failure on sellers parts to do so, you ask eBay to step in, and they will rule in your favor, you get refund and keep item. 

If you are after the 30 days, submit a claim with your payment sources, they grant you 180 days.

If eBay sent you a shipping label, there is no option to go back to the case after 4 days to ask eBay to step in.
