I recently sold a Patagonia womens XS Dark green jacket Brand new with tags attached. Buyer sent me a message claiming item was not as described & had a large stain on the front (baseball size) . I thought it was odd but agreed to let the buyer return the jacket. Had to see for myself what I supposedly "missed" Originally had 3 of the identical jackets which I purchased from REI. I do have proof of purchase. I got the return yesterday and to my horror the buyer sent back to me a Filthy totally stained NAVY Kids jacket size 12. I've never sold a kids Patagonia jacket & my kids are ages 30 and up so there would be no reason I would have this size 12 jacket. This buyer simply took advantage of the return policy and wanted a NEW jacket at my expense. They took a foto of "the stain" which I received but now I know they simply removed the tag from the NWT jacket I sent and put it on their filthy jacket took a foto so they had "proof" They played with changing the color from Navy to green and its difficult to really tell if it was "my jacket I sent them". I have 1644 positive feedback and work very hard to maintain 100% positive feedback. EBAY hastily decided in buyers favor I believe without reading all the messages I sent to the buyer after receiving "the return" and I'm furious. I am going to appeal their decision. They want proof. How do I prove I'm in the right here? What can I do???? 95% of what I sell is NWT. Any help would be greatly appreciated. Sincerely...............Mary

Classic return fraud. It's sad but all too common. Worse yet, there is nothing you can do but issue a refund. You have to add a bit to all your prices to cover such loses. Place them on your blocked bidder list. You can report the buyer, there is that option where you leave feedback. If a buyer gets a number of such reports eBay will remove them from the buyer protection plan.

You could file a Mail Fraud case on the USPS website and police reports with their PD and yours. When you appeal, you can upload copies of those and hope for the best. Otherwise, not much else you can do.
Oh, and after your file the reports, let the buyer know.

They offer the abilty to dispute the case but that is a Catch 22 since there is no proof ebay will accept.
There is no way for you to win.
The best it gets is to accept the return and if you are TRS you get to deduct up to 50% and withhold return shipping.

Welcome to Ebay. It is your word against the buyer's, so you have virtually no chance of winning this dispute because Ebay favors buyers over sellers.
Even if Ebay were to side with you, you could still face the buyer's credit card dispute, which would almost certainly end badly for you.
Our company always make an HD video recording to verify contents whenever a package is opened or sealed. This fact is printed on our invoices to discourage fraud.
You can write off this loss on your taxes if you provide copies of a police report, USPS fraud report, and/or your Ebay dispute.
