Did you actually open a case through ebay or did you just send the item back to seller without going through ebay?

When a buyer receives an item that's not as described, as you did, the proper action for the buyer to take is to open an item not as described case and then follow the procedure.

The seller is required to send you a prepaid return label if he wants the item back and then to refund you in full when he receives the returned item.
