If your buyer opened an item not received case I can only give one reason why a buyer would win a case like that. The seller did not provide proof of delivery by responding to the case with tracking number showing delivery to the buyer.
Many sellers assume that if you purchase a shipping label on eBay it will automatically be shown in any INR cases. No, sorry to say, it doesn't work that way.
If you plan on suing make sure to provide your lawyer with the User Agreement and Money Back Guarantee policy

If they opened a not as described return, doesn't matter if they are fibbing through their teeth, once that case is opened, you don't have any control over it. If you don't respond by allowing the return, eBay steps in and refunds for you and buyer get their refund and gets to keep the item. No returns does not mean no refunds.

What's the fraud here (on ebay's behalf)? What does your legal counsel say?
What kind of case was opened? You have a No Returns policy and if you put your foot down and fought it on that alone... Well, you're selling online and stuff happens.
Seems maybe your buyer received the wrong item? Was it made right?

Not sure I see any fraud especially since you agreed to all the policies when you listed the item for sale on here, but I am not an attorney.
You should never get legal advice on the internet OR as my attorneys always say "you should never post anything about the case on the internet either"

Sounds like what the buyer opened was an item not received case. OP has not mentioned whether or not there was tracking proving otherwise.
