I was told by eBay that counterfeit items were not to be returned to the seller. EBay customer service told me in my case that they wanted the fakes so eBay could turn them over to JBL.
I was told to start a return. Now the seller approved the return. This is not right, the seller can just sell the items again ripping off somebody else.

If you want a refund, you need to return the item. If the seller wants it back, you can't keep it plus get a refund.

I was told that you are not supposed to return counterfeit bootleg items. EBay has told me this before. Items are to be destroyed or given away.
Returning them only gives the seller another chance to ripoff another person. Not returning the item punishes the seller for selling fake stuff. I was told by eBay's customer service that eBay wants the items to send to the real manufacturer JBL.

eBay states you may not be required to return a counterfeit item. Same as saying you might not be required. In this case you're required.
Maybe eBay thinks your word isn't proof it's counterfeit.
Can you imagine all the free items buyers would be getting if all fhey had to say was it's counterfeit and the seller would be forced to refund and the buyer gets to keep it?
What will happen is the seller gets restricted if they rack up too many not as described claims. If they're selling counterfeit items they won't be doing it for long.

EBay is responsible for doing something about all of the counterfeit stuff on their website.
These looked very real including the packaging. Only the fact that they didn't operate like JBL's should and contacting JBL customer service I found out they were fakes. All have the same serial number on them.
I'm going to report this to the FBI and file a lawsuit against eBay. They don't do anything about sellers selling counterfeit stuff. You report the listing and nothing happens. You provide proof of the fakes from the real manufacturer and eBay does nothing.

Actually they have a fleet of lawyers to handle all the lawsuits, just like Walmart, Amazon, and others. If you think they don't settle and don't lose cases, you would be mistaken. All big companies that work with 3rd parties have the same issues and do bare responsibility in many cases. They just use the power of money to keep it quiet. But, most on here don't have the resources to hire an attorney and what is ridiculous with the above is contacting the FBI and getting a lawyer to sue eBay. Why would you do both - at least wait to see if the FBI finds criminal activity - before trying for a civil suit.

To the best of my knowledge, eBay has no facility to receive and store returned items.
Did a CS rep from eBay actually tell you that? What address were you given by whoever told you that?
If you want a refund, you HAVE to return the item to the seller who sent it to you.

First, the item is to be "returned to eBay". In your next message, it's to be destroyed or given away.
Which is it? And who told you that. The correct action, if you want a refund, is to return it to the seller.
If I, as a buyer, knew that I would be refunded without having to return, wouldn't I pull this scam on, I dunno, ALL of the sellers I buy from?

You said JBL said they were fake.
Does everyone agree if JBL hought they were fake then JBL would've had the listing removed? eBay might not believe you but they would believe the verified rights owner. Something is fishy if you ask me.

[chuckle] Before you lawyer up ... you are wrong. Three things.
First, eBay has a strict and robust program for dealing with fakes IF the manufacturer is interested in combating counterfeits. Neither eBay staff nor you are qualified to judge counterfeits, so they allow manufacturers (or their qualified representative) to investigate listings/sellers and remove those listings if they appear counterfeit. This is called the VeRO program.
Second, any product that gets many "Doesn't seem authentic" from buyers, or complaints about the authenticity by the manufacturer, are removed by eBay and cannot be relisted/sold on eBay.
Third, a seller who demonstrates a pattern of buyer or manufacturer complaints about fakes/counterfeits will have administrative actions taken against them, up to being banned from eBay.

ebay talks a good game about fakes but as far as action goes its bupkis
the customer service team also lied to you but the CS always gets a pass when they lie
you cant win win trying to get fakes removed..ebay is as stubborn as the head of facebook
its too much works and it uses up many resources to ferret out the fakes
fake merchandise keeps rolling along as long as its selling.......thats the ebay way
