Can anyone help me??? I ordered what I thought was a sz 9.5 turns out it was a size 5. I tried to get my money back a hour later to no avail. I even have email from sellar saying he was trying to refund. So I sent numerous emails to sellar to again nothing. I tried to ask eBay but again nothing. I thought to try and start a return but I couldn't return something that wasn't shipped and was wrong item and listed 2 times once as 9.5 and other as size 5. I have all screenshots all the emails but eBay denied my claim and told me I didn't return by the date provided but I tried to tell them I don't have item to return and what do I do. No one has spoken to me directly I've been given the run around and now I'm out 70 bucks. How did this happen or better yet how did eBay let this happen when I have all the proof and then some. Any suggestions

Why did you try to open a not as described case to get a refund when you didn't have anything to return? And that would be the wrong case anyway. If you don't pay attention to what you buy it is a buyer's remorse return. You open a changed mind return after you receive them. If you don't receive them you open a not received case.
If the seller said they are trying to refund you should wait and see if you get it the refund. If you don't get it then file the proper dispute when the time comes.

If it is after the estimated delivery date, you should be able to open an item not received claim.

Your post is rather confusing, but I'll take a stab at it.
- It sounds as if you caught your error and asked for a cancellation an hour after your purchase.
- It sounds as if you later thought of opening a Return, but realized that wouldn't be right, as you have no item.
- It sounds as if you have been emailing the seller and reaching out to eBay C/S and finding that fruitless.
As suggested above, your next move is to open an Item Not Received claim if the item isn't to you by the order's EDD.

Even though your return case is already closed, go ahead and
-- file the proper dispute when the time comes, and
-- open an item not received claim after the estimated delivery date.
But if neither of those ideas work,
1. don't talk to the seller again or any more,
2. file a "Not Received" dispute here with PayPal if that's how you paid, or
3. file a chargeback with your card issuer (call the number on the back of the card) to get your refund.
