Buyer scammed me

Buyer scammed me out of an item I sold to him.  Claimed it didn't fit at first, then filed a complaint with card company that the item did not match the description.  Ebay offered NO SUPPORT !  I confirmed with the product manufacturer that the item would fit.  I had to pay the cost of the item plus associated fees.

You should always honor a return request or buyer WILL go to their charge cards as the last resort. You respond to complaints with return for refund.

When they file a CC chargeback, you have the opportunity to respond or just lay down and take it. eBay is out of the picture. It is up to the CC issuer to decide.

I find C C companies being more supportive of eBay members than eBay supporting their Sellers.

 

Once you get a contact info by C C Co, give them the whole story along with copy of your communications with the manufacturer. Offer a return, minus eBay costs and shipping costs both ways. You're not paying back any taxes as well. eBay collecting Sales Tax is a valid opportunity for you to question Buyer's filling a return with C C Co. You don't have access to that money and you didn't collect it, so you can't refund it. C C Co. could contact eBay for that portion of the Sale.

 

Ask for item to be inspected prior to any refund.

 

 

Don't be shy about sharing information. My last filing with a C C Co. was 25 pages. Be an organized presenter. This is what you need;

-A complete copy if Sales Venue 

-Copy of financial transaction, black-out all personal info

- Copy of eBay charges 

-Copy of shipping charges 

-All supportive documents 

 

You want to be a good Seller and look reasonable. Offer return minus your expenses. Your top sentence in bold letters should read: Buyer ignored the eBay 30 day Money Back Guarantee, causing financial hardship on me by constantly changing reasons for his return.

Keep repeating above reason any and each time you're talking to C C Co. They even might drop the return and rule in your favor. 

 

Buyer changed his reason, so you be all good.

In a payment dispute, eBay

- only accepts 1 page, a single image in .PNG or .JPG format, and 

- cannot give you the contact details for the card company (because eBay is only in contact with PayPal or Adyen, and not further up with the card company that filed the actual chargeback against Adyen or PayPal).

Perhaps if you can social-engineer the buyer to tell you who it is, you can send a slide show to the card company.

I feel you. I had chargeback while ago and lost it . My reaction was like yours.  I refunded buyer partially (after buyer returned item as allowed by Ebay policy whe buyer files false claim). Buyer did chargeback for the remainder. Unfortunately there is nothing you can fit on one page of 1.5 mb that Ebay allows you to upload. What can fit on such a small page is tracking details screenshot if buyer disputes not received.  In not as described nothing can be done. You can type detail in word document and screenshot it and upload but in my opinion it will be futile and you will loose anyway. Ebay is lacking in how they go about supporting seller through chargebacks and not allowing seller to communicate with buyer bank directly so you can submit a meaningful packet to defend your side or giving us more info about the nature of chargeback. In fact you don’t even know if the document you upload to Ebay is even forwarded to bank.

eBay cannot forward your document to the bank. EBAY DOESN'T EVEN KNOW WHO THE BANK IS. Think about it, @partfinds:

 

1. The buyer whips out their credit card.

2. Their bank sends the payment to PayPal.

3. PayPal takes their fees, then deposits the rest in eBay's account.

4. eBay takes their ~12.9% FVF, then schedules a payday party for the seller.

 

5. When the seller submits a heart-rending 1-page stick figure drawing --

What chance does it have to reach the bank all of those levels up?

 

When the seller looks up, who do they see? Just eBay.

- Looking up, the seller has no idea if it's PayPal or Adyen, and no idea who is the bank.

 

When eBay looks up, who do they see? Just PayPal.

- Looking up, eBay has no idea who is the bank.

 

When PayPal looks up, who do they see? The bank.

- Looking up, PayPal has no idea who is the buyer.

- Looking down, PayPal only sees eBay. PayPal has no idea who is the seller.

@partfinds In your case, you can take eBay to Small Claims Court per eBay User Agreement.  You were not allowed to adequately represent your case.  

New eBay User Agreement clearly allows members to take eBay to Small Claims Court. Then, once there,  you'll argue: you were not heard and not given opportunity to present your case. 

 

I guess, process will depend on the dollar amount as well. My case was on a $6K transaction. If I had received a 1.5 MB space to present my case, I'll  upload and "serve" all parties involved. What an excellent opportunity to do so?!

In case anyone is wondering:

"Alternatively, you may assert your claims in small claims court,..."

"Regardless of the previous paragraphs, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) any amounts due under the eBay Money Back Guarantee up to the price the item sold for on eBay (including any applicable sales tax) and its original shipping costs..."
