There is NO indication in the TOS verbiage for the promos that the latter would be the case.
This is a very unpleasant "experience" for the sellers who rec'd the latter version of the exact same promotion.
The specifics would depend on what promotion you are looking at. I will reach out via email for more details so we can look into the specifics of this concern.

A site-wide communication wasn't used for this as deals and “save on” items are not new on eBay. That said, we will review this further based on the feedback we've seen from the Community to see how communication to sellers on search features can be improved.
Outside of Daily Deal items, we look at items that are adopted to product identifiers and are price competitive.
“I've conducted a lot of test searches, and from what I can gather, only items that have a UPC or part number in the item specifics that ebay already has in their database to make a comparison are shown for this new search function. Items with no UPC or a unique part number that ebay cannot compare to are not considered. So a seller may be selling an item at half price, but because ebay's database has nothing to compare it to, they will not be shown under "Deals and Savings".
For items outside of Daily Deals, adoption to a product identifier is required. To compare items and identify savings, we need items to be adopted to a product in our catalog.
