refund stolen by ebay!

hey,
I need some help.
I bought something, didn't went the way I wanted so I returned it!
I contacted the buyer who was really friendly and helpful... (still is, however both of us are robbed buy ebay!)
after a while I started a refund process to make sure ebay knows about it and if things don't go well I can  get my money back!
they told me to wait untill a certain time before they step in!
so the time passed, and they just closed the case... oh yeah... they waited that certain day they told me to wait until, and closed the case on that day - "because no action (by me) was made" 😮
now a couple of month passed since the package got back to the seller that I regalurly talk to and both of us want to find a solution.
however paypal deducted my money from his account, and sent it to ebay to refund me.
paypal sent the seller a message that his balance is negative because of that and ebay refunded me!
which is cool besides that this is a LIE!
ebay never refunded me and they made me wait until that time when they can say that the 30 day money back guarantee period has expired!
how  can I get my money back?
now neither of us has the money...
money has been transfered to ebay, who kept it!
what can I do now?

All I can think is that your time would be best spent contacting ebay.  What are message board readers going to suggest that beats contacting ebay or PayPal?
