Hello,
Not sure if this is the correct forum thread, I've never needed to post here before.
So my husband bought a preorder collectible on here for a total of $300. Later on, our friend managed to hook us up with this same collectible for a lot cheaper. I tried canceling the Ebay purchase that was made on his account but I wasnt able to do so like normal. It instead said that it was "too late" to cancel, and I had to ask the seller. So I did. The seller didnt reply, and it was getting about the time that the seller may get the collectible in hand and ship it soon. I wanted to stop the seller from shipping it ASAP so I decided to put in a return. Not long after that the seller let me know he had received the item and would agree to cancel but couldn't because I had opened a return. I tried closing my return so he could cancel, but he still doesnt have the option to cancel. And now I dont have the option of reopening the return. Tried talking with an ebay rep over the phone and they basically say it's in the sellers hands now, and that they were going to email him.. Does anyone have a solution to this or are we just screwed out of $300? He paid with credit card and not paypal -_- Seller gave us a screenshot of his options and doesnt have option to cancel but has the option to still ship the item. It seems we have run into some major tech issues. Could anyone shed some light or know what's going on? I need answers and help. 😞

Not sure what the seller can do to cancel the order, but since your husband paid with a credit card, you will still have the option of doing a charge back if the seller can't figure out how to refund you. You usually have 6 months to do a charge back, so you have time.

This issue as you described is a problem of your own creation. I know you own that as I see how you described what transpired.
I'm unsure as to why you ever opened a return because you had nothing you could return. If your seller wanted to be problematic, they could have accepted that return request, then you would have been required to return the item before a refund would be processed. Which of course you couldn't do because the item hadn't shipped. So the case would end up getting closed in the seller favor and you would not be able to prevent it.
Yes and at this point your seller would have no ability to create a cancellation for your order because of the claim you originally filed, even though it is now closed.
And yes you can file directly with your CCC regarding this charge. The rules for CCCs vary on the time frame you have to actually dispute a charge. It can be anywhere between 60 to 180 days. Most CCCs require it to be filed 60-90 days. My Visa I use for purchases is with BOA and they require it be done within 60 days.
Now the problem with doing that is that your seller is being short changed and has fees they can't get refunded by Ebay or PayPal and that is hardly fair since they did nothing wrong. On a $300 sale it would be around $40 give or take a little. So whatever you decide to do, you should make sure that your seller is made whole. You may try communicating with them and see how they would like to handle this.

You didn't have to close the return, all the seller had to do was click the refund button in the return.
