so I had a hold on an item payment after a return was requested claiming item was fake.
i know you can never win these, I assumed buyer remorse, so I immediately agreed a return...buyer messages me saying they’re not returning the item, they’ll put it down to experience and being scammed??? But they won’t list negative feedback either? Nice buyer...it’s now passed the date for me to receive the item, how long before eBay release the hold on my funds.

You'll have to wait until they decide to close the case.
Some cases they close pretty quick, others take a little bit.

I've got one of these too. My buyer never shipped the item back. You just need to look at the details of the claim they filed, it will tell you when they will close it if the buyer doesn't ship the item back.
But I've found that you can only see this information when you click on the link in the email you got telling you that the claim was filed in the first place.
For me, my buyer opened it the claim on 10/27 I would have approved it on the 27th or the 28th. The claim says if the buyer doesn't ship it back by 11/18 the claim can be closed.
Now the quickest way is to ask your buyer to close the claim. Since they have said they aren't going to send it back, they can close it any time they want to and then that will release your money.

payment is on hold you should check your personal ebay account and click pay to check how long they hold and watch out for messages to see ebay updates
some cases will be very fast and some will take a long time depending on whether they monitor your account for anything unusual

Couple weeks probably.
Just keep your head down and do not contact your buyer lest they change their mind and eventually it will time out.

Just as an update. Mine closed today. The buyer did not ship the item back. So the hold was released and the claim closed.
