Outside finacial institution dispute HELP

Hello everyone,

I hope I can find any kind of solution as eBay itself is not muchbof help. Talking about "sellers protection". 

I sold PS5 with accessories to "lady" back in January. It was delivered with all possible option which was full insurance and signature confirmation. It was delivered 3 days later and signed for as it states on FedEx tracking. About 40 days later(yes 40 days later) buyer decided to file a claim as "not received item".  Problem is she never contacted me nor she eBay. She went straight to her credit card. Her CC filed it with eBay. EBay later on opened up a dispute with me and whatever I sold it was put on hold in same amount as PS5 with rest of stuff. They wanted me to provide tracking information which was right there along wirh listing since label was purchased through eBay shipping. I attached paper receipt which I always save. About 4 weeks later  funds were released wirhout visible outcome of case. About 2 months later which was 3 days ago finally got email that I lost cases and I have to pay back  full amount along with dispute fee. Even with all the proof from fedex tracking # and receipt which was submitted to eBay and outside financial institution of buyer they decided to go wirh her. She decided to delete her account as well which was not suspicious to eBay at all. So now I'm out of PS5 along with accessories along with full selling amount plus eBay sellimg fees and shipping charges. Called ebay and they said it might be a slight chance to file an appeal. I'm trying understand why there is a slight chance with all proof provided? 20 years on eBay and not a single dispute and this? So I asked eBay that I can basically open up new account, purchase 5$-10k item paying with CC and then file a claim with my CC saying that I never got it and  keep an item along with refund? Is there any option besides appeal with eBay? Fedex, but label was purchased through eBay shipping. Courtship since I bought extra insurance? Paypal since my eBay fee payments are handled through them? This is insane that with all the proof there is not much I can do? 

Please help as I'm losong my mind over this.

If the account is gone eBay removed it for some infractions.For a user to delete an account takes months of inactivity.


This is a user to user board not eBay employees.

OMG.. 
I would be fuming over this lack of eBay recourse. 
Don’t give up though.

There is a phone number under buyers address ( if you checked that box on sellers’ profile).

The true problem is the call center agents lie about your position and offer no instruction to proceed. 
Do you want the item back (probably used!) or the money?
CALL eBay support and ask for a manager until you get your $$$ back. 
Call better business bureau, local authorities or any one that could pursue this lady. 
Call, call, call. 
With persistence one day, you will prevail.

I spoke with eBay about this yesterday. Actually she requested her account to be closed. It takes up to 30 days. If account is less than 3 years old  I was told 1 to 2 weeks.

Thank you so much for giving me some kind of hope. It is unreal that eBay gives you general information as far as appeal procces. It blows my mind that somebody can literally steal from you on eBay  and there is no such thing as "sellers protection". Submitted all the possible proof and still thats not good enough. I spoke to 4 different tier managers yesterday. Definitaly not located here in US. Trying to explain each person this situation was more than annoying. Every singe one asked me what kind of solution I'm expecting from ebay as it was already resolved? Resolved? Thats what they call resolution that scammer can get away? Unreal.

Hello Vitriol, you need to understand why eBay is unable to reverse an outside decision to grant an appeal for your refund.

 

eBay is the PAYEE of the buyer's payment, and that payment was debited back from the account that eBay holds at PayPal or Adyen. So eBay doesn't have the buyer's payment anymore.

 

In turn, Adyen or PayPal is the merchant of record on that credit card chargeback. The buyer's credit card issuer ruled against PayPal or Adyen 3 days ago, so Adyen or PayPal no longer has the buyer's payment.

 

Do you understand now? eBay is at the bottom, and eBay is the victim here.

 

When you chose not to manage your own payments, you cannot deal directly with the buyer's credit card issuer, present evidence, and win the chargeback.

That may be difficult, the PS5 was listed and sold for well about recommended Sony pricing for retailers, so the OP may be wary of price gouging rules coming back to hit him on the behind. Just a thought.

That thought is "stinking thinking" because no price gouging happened. The price gouging policy pertains to necessities.

The OP is free to ask what they want. The buyer is free to buy or pass.

Since you shipped FedEx I guess you can't file a Mail Fraud case, but you could go to their web site and see if they have any way of reporting fraud. Otherwise, file police reports online with the buyers PD and yours. File an Internet fraud case on the FBI website.  Then file an appeal on eBay using copies of all these thinks as evidence. You may get lucky.

This is another drawback with Managed Payments. At least with PayPal sellers had another way to fight charge backs. PayPal would actually work with you and the shipper to confirm delivery.

What I dont understand eBay should at least try to get my sellimg fee recovers? Or not? Also trying to understand how her CC decided with all evidence that it was never delivered? Unless she lied she never boight it? Then again her address is right there. Somebody would literally had to wait for delivery at her address and pick it up. 

How about ebay's   shipping insurance which I purchased along fedex one? It blows my mind there could be such a huge loophole in ebay's sellers protection.

Shipping insurance does not pay when tracking shows Delivered.

 

eBay seller protection only covers cases opened on eBay. This case was opened at the buyer's financial institution, outside of eBay seller protection.

 

And again, the buyer's financial institution made the decision.

 

Adyen/PayPal has no say in the decision;

- the financial institution took back the buyer's payment from Adyen/PayPal.

 

eBay* has no say in the decision;

- Adyen/PayPal took back the payment from eBay

- when the financial institution took back the buyer's payment from  Adyen/PayPal.

 

You* have no say in the decision;

- eBay took back the payment from you

- after Adyen/PayPal took back the payment from eBay

- when the financial institution took back the buyer's payment from  Adyen/PayPal.

 

*Neither you nor eBay knows who is the financial institution; only Adyen/PayPal knows who it is.

Yes. I understand all that. I'm just trying figure out since all charges and fees are handled by PayPal would be possible to appeal backcharge with PP as its appears on their statement as case fee?
