Everyone is missing the point on ebay Sales tax fees. It's not about the sales tax being added. The concern is the tax on the tax which ebay deducts from the total sale. Ebay should not he collecting a percentage from sales tax. They are taxing a tax and also charging for processing a transaction. This is against every major card holder agreement. Ebay is essentially putting a sticky note saying "charging for transaction" if under two bucks like a gas station.

It is not a tax on a tax. It is a money processing fee on the tax. All money processors, e.g. Visa, Mastercard etal., do the same thing.

eBay gets to determine how fees are calculated.
Individual sellers get to determine whether the fee calculation is reasonable for a given item when deciding whether or not to list the item.

There is a point here that you may be missing. The state sales tax that buyers pay on eBay purchases is a state sales tax exactly like the state sales tax that you pay when shopping at WalMart or buying fuel for your vehicle. eBay, and other online sales sites, are required by law to collect and remit that tax to the buyer's state if that state is not one of the five that do not charge state sales tax.
eBay's Final Value Fee is not a tax. It is a fee that is charged to sellers who list and sell their goods on eBay. The final value fee on eBay is calculated on the item price, the shipping cost and the state sales tax, if applicable plus on any additional features that the seller uses, like Reserve. That money is kept by eBay and is the way eBay earns money for its stockholders and to pay the costs of running a large online selling venue. These are TWO separate things and should be regarded as such since they ultimately go to different entities.
