You have 30 days after the last estimated delivery date to file an INR claim on eBay. Go to the item on your Purchase history and click, I did not receive it. Select you want a refund on the case page. If you have waited to long, you can file a case with PayPal or if you used a credit card, you can do a charge back. Just do it in the right order, eBay first, then PayPal, then your CC company. Wait until the previous case has closed before going to the next one.
If the seller said they are sending a replacement, they may just be stringing you along so that your refund window will close. Ask them for a tracking number.
