How long until VPP responds? Numerous lies on listing.

So I opend a claim or case, not sure what its called with VPP / ebay motors.

 

I bought a 1996 Ford Bronco

 

The reason I opened the claim is because there are numerous issues that were false in the listing.

 

For example, seller indicated clean title, when I received the car there was no title. I received the car sunday and it is now wednesday and I still have not received the title. He says he is waiting for the title to come back from the DMV because I would have had too many issues trying to register it in my state. Which leads me to believe the title is not clean, why would I have issues registering my vehicle if the title was clean? Seller indicated on sunday I would have the title this week, when I followed up yesterday he seemed to be pushing it to next week.

 

Advertised mileage on the vehicle was 88,000 miles upon receiving it there were 286,000 miles, thats almost 200,000 more miles than advertised. Thats a huge discrepancy. They indicated that they changed the cluster where the speedometer and mileage are because the speedometer was not reading mileage correctly, but the other cluster with the correct mileage is in the car. That just seems fishy, and I cannot verify the mileage on the old cluster yet.

 

Also advertised that the car had a new battery, when the truck driver dropped it off, he had to jump start it to get it off the truck. I find out later that the battery was from 2012, when I went to Discount Auto Parts to buy a new battery the employees commented "That battery is old, they stopped making it in 2012" the employee even called over another employee to look at it,  the other employee made a comment along the lines of  "I havent seen one of those in years"

 

Also indicated new brakes and tires, Tires are good but not new, there are really early signs of dry rot on one of the tires. The mechanic that checked the vehicle for me said it needed new brakes.

 

Also indicated new alternator and water pump which I verified myself that they did look new. So far this is the only thing I can confirm was accurate. Mechanic said they were new as well.

 

There was a power steering fluid leak which was not indicated.

 

The mechanic indicated the car was in good condition other than what was mentioned above. He gave me a run down of things I should do and honestly the work he suggested was expected and I thought reasonable for an old car.

 

Stuff like the battery, tires, brakes, power steering leak & maintenance were expected and really not that disappointing, I expected issues like this with a 24 year old car. Im not even upset by that, but its the accumulation of all those lies that bothers me, especially when you add the mileage and title, which are major issues for me.

 

The listing included an AutoCheck vehicle history report which indicated the vehicle qualified for Autocheck buyback protection, not sure if that means it qualifies for the ebay VPP protection.

 

The autocheck history report provided a range of 45-61 for the score based on model make and year of similar broncos, this car was in the upper part of the range with a rating of 56.

 

Not sure if you guys are familiar with autocheck, but it provides a green checkmark when the specific detail of the vehicle history is good, a red x when the detail is bad, and a Blue i for "information reported"

 

The autocheck report was really good. Everything had a green check mark, there were no red X's on any detail, but there were 2 blue "i's" for information reported which indicated a lien record and corrected title record, but as indicated earlier the seller specified "clean title" in the description

Seller is not ducking or ignoring me, but the accumulation of incorrect information bordering on lies has me concerned so I filed a VPP claim.

 

What do you guys think?

Also, when I filed the VPP claim there was a drop down menu to select a reason for filing the claim, and one of those eligible reasons is "Not receiving the title" so that in my opinion should qualify me.

 

As long as I get a clean title, I can deal with everything else.

Cars over 10 years old are exempt from VPP.

Cars not inspected prior to purchase are not eligible for VPP.

Cars over 10 years old are exempt for odometer disclosure requirements in most states, however, if he states it has 88,000 miles and it shows over 200,000, you might have an issue.

 

Looks like he listed it as a private seller but has sold a lot of cars. So many that he is probably required to have a dealers license. State DMVs don't like it when people sell like that, without a license. If you don't get a satisfactory resolution, you can always suggest to the seller that you will be contacting the state DMV dealer section for guidance. The prospect of an investigation will usually get most sellers like that to pay attention.

Im not sure if the VPP requirements have changed, but they replied to me right away that the purchase is eligible for VPP protection. They didnt mention anything about the car being over 10 years old or not being inspected even thought that information is quite visible.
