What to do if you buy item but didn't receive and seller is a con ? You try to open case they wait and close it for you. Who you should talk to?

It is a fairly automated process to get your refund if you never received your item....
Start with your "Purchase History"
Find the item....from the drop down option select "Item Not Received"
You will be advised to wait a few days (i think) while they investigate..

Just opening a case is not enough. If the seller does not cooperate and cannot provide tracking showing delivery, you have to ask eBay to step in at the earliest opportunity. If you wait too long, eBay will close the case without taking action.

If you have waited too long and the case has been closed for lack of activity, you may still have recourse through your payment method. PayPal and many credit cards offer up to six months of protection.

Did you open an item not received case within 30 days of the estimated delivery date?
Did you wait 96 hours and then return to that case and ask eBay to step in?
It does get "closed for you" if you do not return and ask eBay to step in because it's assumed by eBay that your package was received.
You can't open another case with eBay. You need to (1) open a case with Paypal if that's how you paid or (2) do a chargeback on your credit card.
