New vs Refurbished

Recently I was looking for a Microsoft Surface Tablet and found that many Sellers are not adhering to eBay rules. New, as described by eBay is something in an original RETAIL packaging however, when looking at the "new tablets" I found that many "new" are actually refurbished units from the manufacturer or a manufacturer outlet. How to recognize the difference. If the box is "white and sealed on two sides, it's new and a legit listing. If the listing shows a brown, corrugated box, it most likely is a refurbished unit. Some listings marked "new" are out of the box, the unit turned on and the power cord unwrapped. The point here is eBay is not reviewing the listings, therefore, it becomes "buyer beware"! I have even challenged some sellers who said there listing item was "new" and that was how the manufactured shipped the tablet. I'm not buying that...the items in a brown corrugated box are units that have been used and refurbished!!!
