Item listed as new, but arrived in a factory box labeled "refurbished"

I purchased a Lenovo laptop that was clearly indicated as "NEW" in the listing, but when it arrived, the carton it was delivered in stated "Lenovo REFURBISHED" (emphasis added) and the seller will not respond to my message regarding the disparity.  The carton also states the product WAS NOT covered by a Lenovo warranty.

 

Why are sellers here permitted to list items as new when they are delivered labeled refurbished?

Sellers are not allowed to post conflicting information in the auction but when there are a billion to police it's kinda hard to keep on top of it without the buyers' help.
 
If you did, in fact, receive a used (refurbished) machine rather than a new one then open an MBG request for a non-described item, say nothing else. offer no more information.
 
Your seller has 260 negs in just the last week, I would have passed on the deal. Open a SNAD get a free return label get refunded and buy elsewhere. For starters only buy from a seller who shows the real picture of your item.
 
p.s. Always check with the manufacturer to see if your seller is an authorized retailer that offers a warranty, most items on eBay unless received non-described or broken do not include an enforceable warranty and then its only 30 days.
 
Unless I was buying an older laptop for cheap I will always goto a real store for a new one or their eBay equivalent.

Your seller is too big to search for your encrypted purchase, but I do see they sell both New and Refurbished Laptops. It would be best to check your bought item list to make sure you didn't accidentally buy the wrong one - your purchase price would be indicative of what you actually bought.

Also, your seller states their machines are manufacturer refurbished when in fact they later state it is seller refurbished with a 90-day warranty - again any warranty on eBay unless authorized is an unenforceable term, plus seller refurbished could just mean they wiped off the last neckbeards unforgiving anime crush...
