Greetings. Recently I purchased a PS5 console on eBay. The seller intentionally sent used headphones and printer ink cartridges. This could not have been a mistake as the seller has no other listings. My mistake for taking a chance on dealing with someone who has no eBay history. I have reported this transaction and requested a refund. However given this is fraud and a criminal act I do not want to deal directly with the seller. If I attempt to send back the items the seller could manipulate the situation by saying the items were never returned. Regardless they intentionally sent items with little value on a $750 purchase. Consequently there is no merit in sending these items back based on eBay protocol. Are there any recommendations from the eBay community based on prior experience regarding how to resolve this matter? Thanks.

You need to open a case against the seller.
Go to the item in your purchase history page and click onto "return this item" on the right hand side as such:
When you do this you will see the following:
It is absolutely imperative that you click "does not match description or photos" - entering the correct reason for the "return" is key to a successful outcome.
When you do this. the seller only has 2 options:
If the seller ignores the request, on 4th day have eBay step in and help. eBay will side with you, close the case and refund you your money without the need for a return of the said item(s).
If the seller accepts the return and the label is generated, all eBay looks for is the scan code that your package has been accepted by the post office and is on its way back to the seller. When the delivery scan is done, the seller HAS to refund you.
eBay's money back guarantee works every time...as long as you know how to use it correctly.
Good luck.

Why would you not simply open an item not as described case and then return the items for a refund?
Your seller cannot claim the items were not returned because you will have tracking proving otherwise.

If you want a refund, you have to return what you received.
ALL buyers should really make themselves familiar with the Money Back Guarantee for buyers. It's seen in every listing and gives full information about how to resolve this matter.
