An eBay seller I purchased from used the same tracking number for four different items and then only sent two of them. Now eBay and USPS believe that I've received all 4 items when I really haven't.
I put in claims for the missing items and explained to eBay what the seller had done. I copy and pasted 10 other instances of similar and same complaints from his long list of 'negative' feedback left from other buyers who had the very same thing happen to them.
In both cases, eBay sided with the seller because the item in question was shown to have been delivered to my address. I appealed the first case and carefully explained to a phone representative that this was the very scam I was reporting (i.e. that using the same tracking number on multiple items gave the appearance that all of them had been delivered when they actually had not.) The representative then agreed with me and said I would be refunded. A short time after that, however, I received a new message from eBay stating that my appeal had been denied because it had been decided that their first decision was accurate. (That is, the seller was able to show that all of the items had been delivered to my address.)
I haven’t bothered appealing the second case, because I know that eBay is just going to back up the seller.
Why is eBay looking the other way on this?

Originally I selected 'Did not receive item' option. Seller had a number of days to respond to this, which ended on 1/4/20.
I then opened the case earlier today by selecting the 'I have still have not received my item' option.

No, no missing parts. Each auction item was for a different book. Then the seller used the same tracking number for all four items.

This is from mobile, desktop will look different. You need to click return and select missing parts or pieces. He is winning the case, because the tracking number he entered is showing delivered. Open return cases for the 2 items you didn’t receive.

You need to choose the item doesn't match the description.
If you open an INR, seller will win since tracking shows it being delivered.

That menu is for returning an item. I'm not doing that.
It wasn't 4 books purchased in one auction. It was 4 different auction purchases that the seller combined for shipping. I've had other sellers do the same but they send all items. This particular seller's repeated practice is to ship only a few of them.
But because they're separate auctions, I only seem to be able to submit a claim on them one at a time.
Additionally, the senior representative I spoke with at eBay knew full well what the issue was--we discussed it at length.

You have to start a return request citing Missing for each item that's not in the box. After you lose the case @wmd6324 because the combined tracking number was delivered, go back and start a Return Request:
to return the empty box for the reason Missing Parts or Pieces:
Your seller is responsible for return shipping. Go silent and do not respond if your seller contacts you to close the return request, or offers a replacement. Just wait 3 business days on each return request, then click Ask eBay to grab its bag up off the wall to either get individual return labels, or a refund no return needed.

I was surprised to see just how many negative feedbacks that seller has. I have recently been reading negative feedbacks when I make purchases and I have moved on to other sellers with similar products, even paying a little more for the seller who seems to be getting it right. It's a pain but it seems to be a necessary step these days.
It's also disappointing to hear that you have had conversations with ebay employee, made your case, but were denied anyway. I've had a similar situation. I am grateful you shared and am also grateful there are some technically astute advisors on here sharing how to file a claim.
