returning counterfeit item

If I buy an item from a seller who doesn't accept returns, and the item turns out to be a counterfeit upon arrival, does ebay return my money under 'Get your money back if your item doesn't arrive or isn't as described in the listing' policy?

Open a Return Request for an ITEM NOT AS DESCRIBED, counterfeit. This overrides no-returns. Seller will pay for the return, if he wants it back, and/or refund. If no response by the fourth day, go back and ask ebay to step in. Do not close or let the case expire without doing this, if not resolved.
