missing parts from a seller

i bought 7 gears from a seller and he shipped them priority mail when i received the package the post office had retaped the box because it had a hole in it. when i opend the box 1 gear was missing  contacted seller and he wouldnt even file a claim so i comtacted ebay and they told me to file a police report and submit it to ebay for further action. any one have any idea on this problem

Open a Return Request for an ITEM NOT AS DESCRIBED, missing parts. Seller will either replace the part or pay for the return, if he wants it back, and/or refund. If no response by the fourth day, go back and ask ebay to step in. Do not close or let the case expire without doing this, if not resolved.
