Did you mean:

item not received although tracking insists it was

Am a good customer and do not lie especially about an inexpensive purchase I never received. Am being told a refund will not be extended to me and it is not my responsibility to chase down mail carriers, the post office or neighbors. Legal action may be taken as customers should not have stress added to their lives especially under certain circumstances such as health issues. In court is may be known as pain and suffering. The seller shoudl be banned and it is bad enough that Ebay bucks no longer exists.

The scan from your postal carrier is considered proof of delivery, so don't waste your money on a lawyer.

Instead, go to your post office with the tracking # and ask them to look up the delivery.  The scanners have gps, so they can see exactly where your package was delivered.
