eBay is clueless of their own cancelation policies

I had a purchase that has gone unpaid for 31 days now. I went to research the cancelation policy and got two different answers.  So does this mean I will be charged a final value fee?  

 

Here is one. (which makes no sense as the buyer never paid)

 

This order can't be canceled as it's been more than 30 days since the item has been sold. You'll need to complete the sale.

If you can't supply an item to the buyer, they should open an Item not received case.

If they received the item but no longer want it, they should open a return request. You can choose to let them keep the item or ask them to send it back for a refund.

If you need to cancel an order in the future, you need to initiate a request within 30 days of the sale.

  1. In My eBay, select Sold.
  2. Select the item and then Cancel order.
  3. Follow the on-screen instructions.

Members must pay for the items they win or commit to buy on eBay within 4 calendar days.

Sellers don't need to open unpaid item cases any longer. Instead, orders can be canceled if a buyer hasn't paid within 4 calendar days. If you still have open unpaid item cases, you have 36 days from the date they were opened to close them. If you don't close them within 36 days, we'll close them for you, but you won't be eligible for a final value fee credit and the unpaid item won't be recorded on the buyer's account.

You are in Managed Payments.  The FVF is deducted when the buyer pays.  If the buyer never paid, I don't think you get charged (but I could be wrong).

 

In your first scenario, I believe ebay is explaining what to do if you want to Cancel the order after the buyer has paid.

 

As for the second scenario, sellers can select to have the Cancellation automatically closed on day 5 if the buyer has not paid.
