Seller will not issue a shipping label.

I requested a refund since the item was broken when I received it.  I contacted the seller and he wanted pictures so I sent them.  He then said he issued a shipping label but did not.  I tried talking to him and was told that the item was brand new and was not broken.  He listed the item as used and was not mention of it being broken.  What can I do now?
