The item wasn't shipped on day of purchased as seller stated that would be shipped day of purchase, and I have proof of the listing stating this , but I have reached out to seller, and no reply yet but asked for the seller to go ahead and cancel my order , before shipping costs , and before anyone is out any money , and I just get refunded and the seller can list product to sell to someone else , I see that seller only has 2 ratings and feel a bit iffy with a seller that doesn't have a good reputation on eBay, I reached out to eBay as well and I don't mind waiting 3-5 days for a refund, but to me seller is a bit sketchy!

Buyers can REQUEST a cancellation, but only the seller can file one. The seller is not obligated to cancel the transaction.
Go to your Purchase History and locate the purchased item. What is the last estimated delivery date? You have up to 30 days past that date in order to file an Item Not Received case, to get your money back.
If it is past the 30 day limit, you will need to log into Paypal and file an Item Not Received case there, if that is how you paid, as they allow up to 180 days from date of purchase to file, to get your money back.
If you paid with a credit card, file a charge back with your credit card issuer.
