Seller keeps changing ship date so I cannot file a claim with EBay. Seller does not respond to my me

Have you tried to file an Item not received claim or are you basing your post off messages sent to you by the Seller?  At the time of the purchase there should have been an estimated delivery date and that is the one you only have to wait one day past to file a claim.
