Refund after returns window

Hi I purchased a vinyl record as a Christmas present for my husband.  His father was gravely ill over the Christmas period and passed away mid January. My husband only recently had the chance to play the record due to the situation with his father. I say play but it is actually unplayable- jumps and is covered in scratches. It has been completely mis sold. I have messaged the seller twice asking for a refund and explaining the context of my situation as I’m aware the return window has expired but he has completely ignored me.

The record was around £40 so not particularly cheap. We have been through an awful time and I am upset and disappointed at the complete lack of compassion and understanding that the seller has shown and also that I have paid for something in good faith that is nothing like it’s described. Is there any way I can escalate this issue due to the extenuating circumstances? I’ve looked at various articles but can’t find any information. Thanks
