Hi,
I purchased a presale item 3 weeks ago. The seller has created a label but has not shipped in 3 weeks. I have reached out to the seller twice and gotten no response. Ebay does not allow a refund on an item that is shown as shipped, even though there is no shown movement. I believe in another week I will lose the right to make a claim. Any thoughts, comments? Thank you!

For pre-sale items, the item must be shipped within 30 (possibly 40, I forget which) days of the ended listing. You can file an Item Not Received case when the item is 1 day late, up to 30 days past the last estimated delivery date.

Sellers of presale items are required to provide the exact date the item becomes available in the listing and are also required to ship within 40 business days of the sale. But users must know about the policy in order to use the Money Back Guarantee in the time allowed.
On eBay, buyers have up to thirty days from the last estimated delivery date shown at the time of purchase to file a case. After that, eBay can no longer help.
PayPal and many credit cards provide some protection for up to 180 days from the time of purchase. Check with your card issuer to see if you have any options remaining.
