I recently ordered three items from a vender, and the vender marked the items as shipped, however the items appeared to be not in stock to ship as I found out from the vender after contacting the seller. I order most everything i buy online and this issue happens quite a lot. Is there anything Ebay can do about this practice? it is quite difficult to contact an agent directly. Thank You.

If you do not receive the item by the last estimated delivery date then file an item not received case. Make sure to ask ebay to step in if the seller does not give you a refund after 3 days. Do not let the seller string you along with promises to ship etc....
