Listing removed for violating Medical Device Policy

Hello all.  Thanks in advance for any advice on this topic.  eBay removed one of my listings stating that it was in violation of the Medical Device Policy stating "Medical devices that require a prescription can't be sold on eBay."  However, the item I was selling doesn't require a prescription.  As a matter of fact, the item is for sale by other eBay sellers at this time and the item can also be ordered from Amazon without a prescription.  The item I was selling is the DreamWare Frame by Respironics (size Medium).  The title of my listing was "DreamWear Medium Frame ($AVE) Respironics CPAP Accessory" and was listed in the "Health & Beauty > Health Care > Sleeping Aids" category.  I have a Qty of about 60 of this item I would like to sell.  eBay removal notice also stated I would be subject to a 3-day restriction period if I relisted another item that violated the policy.   Is it possible to appeal the removal?  Can I safely relist the item using a title & category similar to another seller's listing for the same item.  Feedback much appreciated.

You need to read more than the first sentence of the policy.

 

CPAP machines and accessories are not allowed to be sold on eBay (it doesn't matter if they are sold elsewhere). If you find other listings that violate this policy, you can report them to eBay using the link on the listing.

Hi @drbama1991 

 

Once a listing has been pulled … you can count on it being pulled again if relisted.  [If you have been warned about a 3-day suspension … then you must have had a listing pulled more than once.]

If you could have listed the item without mentioning CPAP … you might have been okay … but it likely is too late to try that now.

 

The other listings you see might also be violating eBay policies … and just haven’t been discovered yet … so I wouldn’t advise copying them, since you’re already on a bot’s radar.

Again, thanks for the valuable feedback.  

I did have one earlier listing that was removed due to violation of the Medical Policy, but that listing did include an item that requires a prescription.  I did not think the DreamWear Mask Frame violated the policy because it can be purchased without a prescription.  Lesson learned.  I will find another avenue to sell my inventory.
