Item never received, seller stopped communicating

Purchased an item from a seller in Texas for $139.75 to be shipped to Florida on Oct 25. Somewhat heavy antique tractor parts. On Oct 27 it was reported as being shipped. Tracked fine until it arrived Nov 1st at  the UPS facility in my town and “Merchandise is missing. UPS will notify the sender with additional details. / All merchandise missing, empty carton was discarded. UPS will notify the sender with details of the damage.” 

Immediately after seeing that I sent the seller a message. He responded, said he would look into it. I also started a claim on Nov 4, just so it was documented. In the week following that I sent a couple messages trying to stay in contact, only one reply “i got the ups form today about the Request for claim payment. for the adders you want the check sent to you want me use the same one i sent the arms to and what was the total amount ebay charge you”.  I gave him the info he needed.

 

I sent about two messages to seller between then and Nov 10 to keep communication open. Nov 10, eBay emails asking if this has been resolved and I replied that it has not. Then I contacted the seller again telling him eBay is asking for an update and the seller finally replies on the 16th “yes i sent out the ups paper work out there post to be sending you a letter if approve for return check or not if you are approve you be getting a check from them”.  

Confidence in this deal sinking fast, but I was giving this guy the benefit of the doubt, and trying not to be a total pain in the butt.

 

On Dec 3 I got an email from eBay saying my request is closed due to inactivity. What? Please explain to me how that was inactivity?! I have since tried to contact eBay and the seller, ZERO response, and since the claim is closed by eBay I can’t find a way to reopen it, there is no way to contact anyone at eBay, and the automated help I get there keeps leading back to the claim request closed. Am I screwed?


The only thing I was able to find to communicate this to eBay was the “how was your experience” survey, gave honest feedback and got no response.

 

Since the start, I tried to maintain contact with everyone. UPS has said I need to remain in contact with and resolve this with the seller and eBay. But eBay and the seller have been no help. I used a CC for the purchase, so I can’t file a claim with PayPal, so I think the only thing I have left is to file a fraud claim with my bank…not even sure that will work since this was a purchase I deliberately made and not an unauthorized purchase. 


What can I do at this point? It has been like 52 days and the seller won’t respond. Please help!

When you corresponded with the seller, was it within the Case?  If you communicated outside of the case, ebay doesn't know that, and that is why the case was closed with inactivity.

 

Since you paid with a credit card, file a charge back with your credit card issuer because you never received what you paid for.

Yes, several emails were sent within the 21 day case period, but when I look at the message history for the case prior to it being closed, very little of it is shown there. I do have record of the communication in my emails and message history in the eBay app. 

Something positive today though, UPS got back to me and said the claim paperwork was just received and processed. However, they say to coordinate with the seller for further assistance. I’m not holding my breath for any communication from them at all.
